eBay Buyer Gives Positive FB then Files Dispute

Dear Ina,
Passing on an annoying eBay case. I sold a collectible item August 1 and received positive feedback from the buyer. It was a low value sale. The buyer had plenty of positive feedback, which admittedly doesn't mean much. About 10 days later the buyer left positive feedback for me, saying the item was great. 

In mid September, eBay notifies me that a buyer filed a payment dispute for the order (i.e., disputed a charge directly with their credit card issuer). Note this was a payment dispute, not an "item not received" dispute. I respond to eBay with a screenshot noting the positive feedback by the buyer, suggesting that the buyer acknowledged making payment, receipt and satisfaction with the item. 

eBay then notifies me two weeks later that the dispute was found in the buyer's favor. Ok, whatever. 

Since the value was low, not worth my time in raising the issue further on the phone with eBay customer "service", especially given I doubted there would be any change. Yet again, though, the inability to leave negative feedback on a buyer grates. 

Question for other readers: what would y'all have done? I assume eBay does absolutely nothing to engage a card issuer with any evidence of a legitimate transaction, as opposed to buyers remorse or something else.

eBay does as little as possible EVERYWHERE ALL THE TIME.

That’s why CS is so bad, it’s bad because they “don’t have to spend money on it”. Plenty of people will say it’s just fine.

Here, it wasn’t worth eating the chargeback, it was easier to just pay the buyer off by refunding.

I doubt you got a defect, since you are in the right but call and double check to make sure.

Well, it’s not their money, so it definitely IS cheaper, no matter how much.  Though there may be a threshold depending on how much fee they would have to refund you.  Plus, they would charge you for ‘fighting’ it and then do this anyway.

However, evidence sent to the black hole of eBay might also be sent to the buyer, certified, along with copies of your correspondence from eBay supporting the buyer’s mendacity.  Maybe a polite reminder that they need to either return the item to you (if not otherwise consumed) or immediately make payment to you directly by an ‘authorized’ method, so you can avoid a need for further investigation.  If they may balk at shipping, note that “being allowed to keep what isn’t solicited’ is negated by the said evidence enclosed.

No guarantees of course, some folks just have no shame.  But we’re all kind of where we are today because we haven’t at least called out this kind of behavior to hold it accountable.

You should search this site for buyer's I.D.s

File report with USPS Postal Inspectors as using the mail system to commit fraud is a crime. They may send a letter to the person, but not likely take action unless a pattern of multiple cases have been established.

Report buyer to their state's attorney general.

A police report is likely to be waste of time but consider filing one over the internet with the police in buyer's location. If they lack local police this could be country sheriff's office.

In 26 years no one has ever filed a claim with their credit card on my account. There have been a handful attempts at feedback extortion. Two dudes cancelled their PayPal payments immediately after getting the tracking number in attempt to steal the item and shipping, but I had  the carrier pull the items out of their system and send back to me, which was free at the time.

I created a free blog on Blogger to deal with these people. I publish a full account of their misdeeds with pictures to back it up. I include their full name and contact information in each post, which are highly detailed to the point of being suitable for evidence in a court case.

In one case I actually ran a description of one of these attempted extortion cases on eBay as a listing (not including the contact information). I was "selling" a printed copy of the case, but anyone could of course read it for free. The buyer was not too happy about being exposed and the listing was closed after several days, but then perhaps she learned her lesson about interfering with listings that clearly state anyone from her country is not allowed to buy the item. eBay also removed her negative feedback for not being allowed to buy the item because my TOS in the listing specifically includes terms spelling out exactly who can buy and who cannot buy.

Back in day eBay would blame PayPal and then PayPal would blame eBay for returning the buyer's money. In reality its the buyer's bank, payment processor or credit card and that has the final say on the matter. Of course there is no actual investigation on the part of these third parties or eBay. In the case of eBay you are in all likelihood talking to someone at one of their Indian call centers who are paid so low of wages it would be illegal in the U.S. Their so called supervisor that they need to connect you to is someone sitting in another cubicle at the call center. These people have no power to do anything, are incompetent and lie through their teeth. This is why you should believe eBay's claims you are covered once an item reaches a eBay international freight forwarding center or a private freight forwarder.

There are clear seller protections for Disputes if you follow the rules. Read the guidelines and educate yourselves instead of mindless statements
We have successfully beat 100% of nearly 500 in recent times.

Just got a claim that will be interesting.  I sold a brochure of an item (listed in advertising with multiple pictures and brochure being the fifth word of the title).  They sent me a nasty message that they ordered the item and not a poster of it (their words) and that I should be ashamed of myself.  I told them to return the item as I have free returns.  Instead they put in a claim with their credit card company which is funny- they want to keep the item they allegedly didn't mean to order.  I pay the shipping back but they'd rather still keep the item in question.  In a logical world, that would be laughed right out of the process as it's simple- return the item on the seller's dime and get your money back but we all know it's going to be a struggle for good to win over evil!

eBay buyers are the worst of any site that I sell on. eBay have trained them well to get away with just about anything.

My least favorite are the ones who file a claim on the 29th day after receipt and then keep the item for an additional several weeks before returning the item.  I had one last summer file one on the 29th day after receipt stating that she had "ordered it by mistake".   It took her 29 days to realize that she ordered it by mistake?

eBay has been in business for 30 years and last week it let a buyer file a claim for not as described and printed them a return label at my expense. However, the buyer had no way of knowing if it was not as described because their ebay address lacked their apartment number and the item was already being returned to me as undeliverable. Wouldn't a few lines of code have prevented the buyer's faulty claim just by looking at the tracking?

Credit Card chargeback allegedly cost eBay hundreds of dollars when they are opened by a buyer. Back when Pay Pal processed they told me as much. Pay Pal OFTEN fought for me with CC company. A woman alleged 14K gold earrings caused her to break out. Pay Pal fought, lost, buyer kept earrings she was "allergic "to and Pay Pal refunded me my money. A $300 pair of earrings cost Pay Pal about $500. The buyer in the post here is a criminal. I recently went through a similar nightmare over a $20 item. A buyer ordered a necklace titled Pink, described as pink and was pink in the photos. Buyer opened an INAD return claiming she thought it was beige, she "can't wear pink......". She threatened to get "eBay admin involved" if I did not approve return. She claimed she was a little old lady and I was a bully. She claimed she talked to eBay and they were "holding all of my payouts through December..." ALL lies! She is 55, lives in a million dollar mcmansion in Olympia Washington with a 75 year old sugar daddy, has an eBay store with 300 "fashion" items and never apparently contacted eBay. I ultimately approved the return intending to just deduct 50% to pay for the postage both ways. When I could not I contacted CS (about a dozen hoops) and after a brief conversation then their review of the messaging, eBay opened a case, ruled in my favor and closed it with NO REFUND to buyer. She may file a charge back, who knows? But eBay needs to reign in these frauds. We can only do so much to protect ourselves.
