EcommerceBytes Publishers Settle Lawsuit with eBay

David and I officially settled the lawsuit we filed in 2021 against eBay and its former executives over the stalking and harassment campaign we endured in 2019 designed to stop our reporting. The landmark civil rights settlement includes $55.7 million in compensation and charitable commitments.

Our lawyer Chris Murphy summed up the reasons we battled it out for over 6 years when he wrote:

"This case was always about more than obtaining financial recovery. From the beginning, our clients wanted to uncover the truth, protect journalists and publishers, hold those responsible accountable, deter future corporate misconduct, and help ensure others would never have to endure what they experienced. Through years of discovery, motion practice and trial preparation, we were able to accomplish those objectives while securing meaningful compensation for two wonderful people. We believe this resolution sends a clear message that corporations and their executives cannot engage in this type of misconduct without facing significant consequences."

Below are links to more information, we'll continue to add updates.

"As we have long stated, what the Steiners were subjected to by former eBay employees in 2019 was wrong, reprehensible and should never have happened. We condemn, in the strongest terms possible, the employees who perpetrated and pled guilty to criminal charges for the misconduct against Ina and David Steiner. We also acknowledge the unprofessional tone in internal communications demonstrated, to different degrees and number, by Mr. Wenig, Mr. Wymer, and Ms. Jones.

"We continue to extend our deepest apologies to the Steiners. This agreement is consistent with our commitment to fairly compensate the Steiners and fulfills our efforts to make things right.

"The 2019 conduct is not representative of eBay’s culture or thousands of employees around the world today. Since these events occurred, new leaders have joined the company and eBay has strengthened its policies, procedures, controls and training consistent with the company’s ongoing commitment to uphold high standards of conduct and ethics."

Bravo!  I wish you had never had to suffer what eBay and its thugs did to you.  Huge respect though for pursuing justice - not easy at all, yet more stress and pain.  Y'all deserve the compensation, and then some.  Every penny.  Let's hope eBay and other marketplaces (and frankly all companies) sit up and take notice, and learn.  Sadly, I fear many won't.  Will they ever learn?

Nice timing, i just watched the documentary last night,  even after hearing the story here it was pretty shocking.  i'm really glad that you won and got the amount that you did.  i said years ago that you should you deserved at least as much as wenig got to leave.

as much as i would hate to lose this site, i would completely understand if you and david decided to go off and live your life in peace.

I think the most important part of this is the compensation from individual officers and employees.  So often the execs suffer no consequences.  Well done.  Sorry it took six years.

WTG.  Why don't you use the money to create an online selling site to compete against eBay.

Taught them nothing as sociopaths have no conscience.

They continue with their crooked business practices.

Back in the day they used to put a small logo in their header bragging about how they were powered by Microsoft technology. The'r business practices have made Microsoft look like a small time player.

27 years of selling experience on eBay without a single chargeback form customers and they started demanding receipts for every item listed or sold in the last 60 days. Just an attempt to send you a multiple weeks wild goose chase before suspending the account anyway due to criticism against them.

David and Ina's case hits close to home. ASGTG has been to Amazon what EcommerceBytes was to eBay: an independent publication the company didn't want to exist.

In my view, Amazon chose a different tactic, using what I contend was a false and inaccurate indictment to silence me and ASGTG, knowing that for ordinary people the process itself becomes the punishment.

I've documented the evidence and my reporting here:

Congratulations and God Bless!
A true David & Goliath story finally came to a positive conclusion.

I've been reading your blogs and appreciate every tidbit.

Know that you are not alone in the anger and I praise you for exposing large corporations and their nefarious activities that hurt sellers and customers.

I have been your biggest supporter for decades. Wonderful news. My whole concept of corporate america changed after that terrible incident. I honestly do not know how any of the higher ups at eBay survived afterwards

Finally some justice for the little guy!  I can't believe this even happened to you.  I have been following this story since it broke.  It is sad to see how money and power really corrupts people.  I have been reading your blog since the early 2000s!  Thank you for going through all of this to send the message that they can't get away with intimidation and threats!  We need to keep fighting the fight!

I’m glad they won, but I feel like this case may go much deeper. I remember around 2019, you couldn’t go anywhere online and raise concerns about eBay without being attacked. On Reddit, Downdetector chat areas, and other forums, negative posts about eBay would suddenly get mass-reported and deleted, while people would flood the comments calling you an idiot for criticizing the company.

At the time, most of us assumed they were just trolls. But after hearing the details of this lawsuit, it honestly would not surprise me if eBay had people across the internet doing damage control whenever something negative was said about the company. I’m not saying that has been proven, but what happened back then looks a lot more suspicious now. These days, people criticize eBay on the same sites without everything immediately getting flagged and removed.

A genuine and sincere CONGRATS! I cannot imagine what the two of you went thru, and I am so happy that the offenders got what they deserved, and that the two of you had the brass to pursue this. Well Done!

Good for you. I hope Wenig had to pay at least some of that personally. Sucks when you have to actually pay some of the "noise".

Congratulations !!!!  I know this had to be a long and hard fought ordeal for both of you.  One that of course should have never been necessary.

Thank you for getting some money for some well deserved Charities.  That is a really big deal.  Again, thank you for thinking of them.

I'm also happy to hear you were able to pierce the pocket book of Wenig, Jones & Wymer for some money too.  They should have been made to pay!!!

Again, CONGRATULATIONS and welcome to your future of unlimited opportunities!  One of which I hope is a vacation to the place of your dreams.  Certainly well deserved.

Amen to a horrifying story. What you endured no decent people like you should have, and I thank you for standing tall during this awful ordeal. I hope that this gives you some well-earned peace; you already have all of our respect!
