Vet Vows to Fight Outrageous Attacks on Sellers Like Him

Many of us that sell on eBay or other online platforms also have brick and mortar store, or will have one day. 

All of us like to think we are too smart to get scammed. When a company sets out to scam and defraud Veteran and Minority business owners and uses attorneys and the legal system to do it, there is not much we can do. 

I want to warn all small business owners to always do a lot of research before signing any kind of lease. Even if you think you are smart enough to understand the lease, you will still lose. 

My store is Veteran Owned. One day a guy shows up with a new and better credit card processing deal. We get these call every day and ignore them. This guy though had his story down pat. 

When I asked him how he could charge us such low prices on credit card processing fees he told they were trying to Honor all Veteran owned stores and we would get the same processing fees as the big box stores like Target and Sears. 

To make the deal even sweeter he said they would provide us brand new state of the art credit card processing machines capable of taking chip cards and pin pads for debit cards. Then he said all the thermal paper would be free. Wow - sound too good to be true? It was. 

He told me my credit card processing fees would be slashed by 30%. He produced a lease for three credit card machines and said it was a 0 dollar lease but they had to account for the machines and the lease would show I had three of them. That sounded reasonable. 

He made a production out of writing a 0 in the lease amount and said he would have to have his boss approve and verify we were veteran owned. Again, that sounded plausible. 

The credit card machines arrived, and he installed them and left. Right away we found out they did not accept chip cards and no pin pads. Called the salesmen who assured me it was just a software issue and he would be back to get that fixed. 

When my first processing statement arrived instead of my costs going down 30% they went up 40%! Then they started taking out $240 a month for the lease of the credit card machines. The salesmen had taken the lease I signed and changed it to $209.99 a month. But they took out $240 a month. The extra they said was for taxes which they never paid to anyone. 

By now the salesman was long gone and did not return any calls. I cancelled the deal for processing the credit cards after the Missouri Attorney General got involved. 

The bigger issue was the lease on the machines. It is written in the lease that any dispute had to settled in a New York Court. I tried to stop them from taking money from account and after 8 months had to shut down the bank account. Then the calls and mail started. Nonstop harassing and threats. 

Now I am in litigation with them after they filed a lawsuit against me in New York Court. I have learned that this company has scammed thousands of Minority and Veteran Owned Businesses since 1991 for hundreds of millions of dollars. Most people cannot afford to go to New York or hire a New York attorney and spend $10,000 to fight a $4,000 claim. 

The New York Attorney General has a suit against them to try and stop them. It is the 2nd time they have filed suit. The company has an army of attorneys to delay court filings and any lawsuit against them will take 5 years or more to come to an end. No one small business could ever pay what it would cost to defeat them. 

Class Action? Nope these guys are professional crooks. They change the contract or lease constantly so there can never be a group that can get class action status against them. It has been tried numerous times. 

The credit card machines they sent me were obsolete and could be bought on eBay for $39.00

I am fighting them on my own in the New York Courts. 

Everyone should always check out the BBB and other sites before ever signing any kind of lease. The government has been paid off and will not protect you. You must take charge and check out every company that you deal with.

I am so sorry this happened to you - and thank you for posting the warning.  In today's world where so many conscienceless scammers take advantage of anyone who will take their bait, everyone -- not just veterans and minorities (and yes, you are a chosen target) -- needs to be especially vigilant.

The old saw about "If it sounds too good to be true, it probably is." is more applicable than ever.

NEVER - EVER - EVER - sign ANY legal document without taking it to your attorney to review and approve.

Sounds like new york is in on it. If they are changing adding any numbers after the signature, no lawsuits are needed for the government to get involved.

I would look at federal court since if they are doing business across state borders and commiting fraud, that then goes to a federal level. Make a claim to the FBI

credit card processing salesman are nothing but whores. They will say and do anything to get you to sign. Wells Fargo I found was the worse.  Paypal can get you a machine for nothing (I think) and square and paypal can process your payments on your smartphone. So so sorry this is happening to you. Life is one big learning lesson. Hope you have enlightened some future victims before they too are caught.

You should've called the police and made a report. I do believe that would be a felony!

Why did you wait so long? After the 1st billing you should've closed that account.

I would not trust anyone who walked in off the street and offered me a too-good-to-be-true deal. Like the scammers who telephone me on an almost daily basis and try to get me to sign up for a credit card with 0% interest for life. And never make any decisions on the spot. With all the information on the internet, anything and everything can be researched. Also, as has already been stated, take any contract like the one described to an attorney to review. A couple hundred dollar attorney billing is much better than the thousands some rotten scammer could cost you.

Imagine! Scammers using the whole "veteran" thing to get the confidence of a small business owner and taking his/her hard earned money.  Happened a LOT after WWII when housing was in demand and the GI bill was new, too. The scammer would pose as a real estate agent and "sell" a vet and his new wife a house who some time later discovered that they had only signed an elaborate lease-to-own scam that was so complicated no family could meet all the requirements. OR the scammers were selling a house they never owned but were taking money from vets. Every veteran should be aware of vet-targeted scams and protect themselves. Not checking with the BBB, the local police, the state BCI, their own lawyer, before signing ANY contract is asking to be scammed, especially if they tell you this is offer is available only to vets. And especially if you have to decide by the end of their presentation. It's up to everyone to use critical thinking skills to protect themselves.

You might try contacting the Office of Veteran's affairs https://www.va.gov/LMR/Staff_Directory.asp and see if they can apply some political pressure to get results.

I never trust any salesman that comes to my door or calls on the phone. Their pitch is always a big production and all you want is a bullet-point list and the cost. When you finally manage to get the price out of them 30 minutes later...What?!? Sorry, but you just wasted 30 minutes of our time. Then they try to take forever packing everything up.

This happened last year when we were looking to replace all of the windows in our house. They came to our door to make an appointment with a representative who'd come by that weekend. We thought, ''Cool! We're getting that project checked off our list and we didn't even have to call anybody.''

They wanted $25K!! So, it was a double let-down -- not something we can afford and the project remains incomplete not knowing if we'll be able to get it done when it really needs to be done.

As luck would have it, a neighbor got theirs done in January, so we got a reference from them. Yes, a representative came by, but used the 30 minutes to help us choose what we wanted and then tell us how much, when they would do it and how long it would take, and get the financing set up. We got it done for $8K, including the double-pane windows we wanted!

So, we were just reminded why we usually ignore salesmen who come to our door or call us on the phone. LOL

You will always be at your most vulnerable when someone tries to sell you something you did not make a plan to buy.

Even if the deal is bona fide, your negotiations will be disadvantaged because they will be wholly reactive.

It's also why advertisers need to be creative - to make you forget all that.
