Seller Pleasantly Surprised to Win an eBay INR Claim

Dear Ina,
A buyer stated item was not received although delivery confirmation was verified for her zipcode. Then stated item was delivered to someone else, hoping that they would return it to her, but filled a "did not receive item" claim just in case they didn't.  

Claim finally got to the point where it was escalated to eBay for a decision.

We received tracking information that shows the item was delivered to the buyer's address.

This is a first! eBay actually believed me, not the buyer.

This is the one area that Ebay actually will back the sellers if you have entered the tracking number before the estimated delivery date.  When the buyer claims INR all you have to do is enter the Tracking information showing that it was delivered and Ebay will rule in the sellers favor 99.9% of the time.  It should be 100% but you know how Ebay is, always has a glitch in something.

Nothing new. Ebay has always used tracking to prove delivery. Ninty nine percent of the time if ya all got tracking you win.

Now try winning an INR when you don't have tracking and the scammer says it wasn't recieved. Thats the trick.

Point future reference.  Provide tracking number to (any) post office and they can verify the precise GPS location where the delivery scan was made.  Not only can it 'prove' the delivery, (and time/date), but can also serve to locate potential misdeliveries so they can be possibly corrected before eBay makes their 'informed' judgement.

This is the only seller protection left on ebay. They have not yet found a loophole to challenge or refuse an official online tracking record from an entity that's part of the US executive branch.

But I have faith in ebay that their lawyers are working diligently day and night looking for a way to end this protection.

Happened to me a few times.

I really with there was a site where we could contribute scam buyer user id that we could add to our block list.

the only claim a seller can win 99% of the time is a INR that is confirmed as delivered.

don't understand why the op is surprised that they won this case.

Glad that went well.  But always keep your fingers crossed. lol

I have a mail delivery gal of the old school on my home's route. She scans all packages two or three hours before she get to the house.  Does her entire route that way.  Also anything that requires a signature, the person is automatically not home, and the notice is dropped in the mail box. Never gets out of the truck to attempt actual delivery. Sometimes old school just sucks.

Many of us have spoken to her to no avail. So, we are doing the complaint business until she is moved to a different route (the normal solution, it seems, in the area I live).

My postman scans a bunch of packages at a time before leaves the truck, so I know the package is coming a few minutes before he opens my porch door.  Unfortunately his substitute when he is out, does the same and delivers everything to the wrong house... the second time we confronted her and she admitted the envelope we were expecting went in the mail slot next door where they were away for the month.  Two strikes and the third time we will visit the postmaster.  But for the original poster - I'm not sure you won.  We had a package delivered to a regular customer go missing.  She found the box and inner packaging down the street.  Clearly a porch theft.  I refunded her money and told her that future shipments will be signature required.

Good news! eBay is (FORCED) to back up sellers who do things as a instructed procedure of ebay.

EXCEPT eBay has nothing to do with it - does it? Does charging a %10 VIG for something you have nothing to do with, automatically give you the right to decide how things should go?

Unless there was a change while we were all sleeping, eBay stood up in court and proclaimed "we have nothing to do with any of these things - specifically how/what and where things are listed - SINCE WE ARE JUST A VENUE.

More over - eBay ADMITS in its 10k statements that it PURPOSELY does actions that its own seller base intensely hate. The fact that in this ONE instance, eBay does the right thing, ISNT an A+, not at all.

eBay isnt "standing up for sellers", it has no choice to. eBays policies are ONLY based on losses IT MAY OCCUR should a buyer go back to their cc company and complain.

That USED to be the domain of Paypal - who eBay pushed its losses on (on Paypals books), but cant anymore since the split.

Sellers are fodder to be used to get eBay riches - even useless eBay employees (like the ones that run "seller protection",, and no more.

Is this a victory for sellers? Yes - but only in the most shallow of terms. Its more a loss for eBay since they have to eat the loss themselves ....
