Fraud Victim Seeks Help in Getting Answers from eBay

Dear Ina,
I am new to commence and do not know the rules. I have a complaint concerning eBay that I think the world needs to know. Here it is.

The eBay gift card system was used by criminals to defraud me of $5,200. I filed a police report. 

The investigating officer, in coordination with eBay, discovered that $1,825.04 was still in the criminal's account. That amount was frozen for subsequent return to me. 

That happened in October. I have heard nothing from eBay concerning my money and they will, essentially, not talk to me. 

I have no recourse but to file a Small Claims Case against eBay. They will not tell me the name and address to "process serve." If any of your customers are willing to share that information, I will be grateful. I know from your site that there are those noting that they have had eBay served.

Consider filing a criminal complaint against eBay. From your letter, a crime was committed. It sounds like you have an outside Law Enforcement origination that has confirmed it. With their help you have frozen the funds of the criminal and eBay will not provide the necessary information or help to claw it back.

With help from your Law Enforcement source, you should be able to file a criminal negligence suit against eBay. The district attorney can look up the Corporate agent for Law Enforcement to serve an  Indictment of the Corporate officers. The amount is way over a felony. You may find you'll need federal help since it was across state lines.

I would go this route instead of filing a small claims as you have user agreement that states you must go to Utah to file any civil complaint and it has to go to arbitration. They could delay that for years if they wanted to. The publicity from a Criminal Complaint/indictment will cause them no small amount of heartburn. They will want to pay fines and get you your money back in lightening fast speed.

This is just an opinion. Please consult with the people that helped you originally that are not from eBay.

I don't think anyone will be able to offer you any meaningful legal advice without more details.If the gift card were purchased using your paypal, or bank, just file a charge back.

If you think you have a case, click "17. Legal Disputes." ebay pays for arbitration claims under $10,000.

There's not enough info to even tell who is at fault.

The buyer, the seller, eBay or Paypal. . . . .

@Dburn, where in this story does it mention crossing state lines?

@George (the OP) - You don't indicate where you are located. Since you have already filed a police report, you should next file a complaint with the Attorney General for your state, and also the Better Business Bureau.

eBay Inc. is a Delaware corporation, and their agent for service of process is C T Corporation System.

Read the information that NoMoreEbay has linked to and follow the instructions set out.

If you have a local television station or newspaper with a consumer advocate on staff, you should take your story to them. There's nothing eBay hates more than negative publicity, and will be more likely to refund the money you are owed quickly if they think your story will spread.

You might also want to contact Daily Mail Online as they are read by people all over the world and they love to publish horror stories about eBay.

You will be shocked at how quickly you will get eBay's attention if a story airs publicly.  Good advice iheartjacksparrow.    

Stay on course and use every avenue available to you.  Do not let this buyer get away with this.

When I have a transaction with a buyer on Ebay I get their address so I can ship the item.  Is the OP looking for a different address?

Hmm, from what I’m reading maybe you cannot do this suggestion. Couldn’t you file a charge back on your credit card? Also, what is PayPal saying about it, if you used PayPal?
