Why Are Some eBay Sellers Designated a Business?

Dear Ina,
I think this is new but wasn't sure.. I am seeing profiles with this "Registered as Business Seller" notation. Any idea what this is and if it gets you extra exposure?   

I ask, because I have been a business seller on eBay for 14 years and I don't have the designation like some do.

Here is a new Chinese seller that just started selling (account is several years old but they just started offering tons of stuff) and they have it? Any idea what gives on this and/or can you check with your followers or eBay?  And this guy's stuff is ALL counterfeit, so it's odd eBay would give these criminals the designation but not honest and law abiding sellers...

It is a function of how one sets up their account.  Being a 'business' is not sufficient, one must register with eBay AS one.

I am registered as a business but it doesn't show that in my profile or anywhere for that matter.

Sunflower, my listings don't say "Business Account" anywhere, but my business name shows under Seller Information.

IIRC it became a law in the UK with business sellersa few years ago. You'll also see their address and phone number too on listings.

They're handled by ebay and the government differently than a private seller.

@Bob V-Yes in double checking that is the only place I see that my business name is located, under Seller Information. It doesn't show in my profile nor does it say so in my store.

There is a big difference between having a business and having a hobby or yard sale.

Just because someone considers what they are doing on Ebay is a hobby or yard sale type of endeavor does not make it so.  Some try to justify not paying taxes on their income from online sales by saying they don't have a business.  

IMHO having the "business" distinction on Ebay has very little value to most sellers.  But it can be important in branding.

Governments are always looking for tax money.  Here in Canada, the Canada Revenue Agency (the equivalent of the IRS) routinely and legally checks Canadian resident eBay sales on all international sites to determine if folks are running a business.  If one has a measurable dollar value of sales each year, the CRA will see if the seller is registered to collect sales tax and if the seller is reporting income.  If not, there may be a first friendly phone call to ''come on down'' and bring all your bank records and supporting documentation.  One local-to-me chap had failed to declare eBay income for a number of years and wound up being assessed several $100K in past due taxes, a penalty of 100%, plus accrued interest.

Don't think it won't happen if you keep your head down......not being paranoid here, but 'the Gov't'' does check your lifestyle versus declared income....it's all out there in a traceable way.

Here in the US, if an Ebay seller has $20k in sales in a given year, PayPal has to issue a 1099 which is sent along to our federal government too.  Here they are call IRS.

You are correct. This only applies to UK sellers, not US.

Funny thing here is that many US sellers think that if they do not sell over $20K (and do not receive the 1099), then they do not have to pay income taxes on eBay or Amazon sales.

One thing for certain- if the 1099 is issued, the IRS will come knocking if the form is not filed with the taxes from that year. I know some folks (not me) this has affected.

Yes, you are absolutely correct.  There has been a few time here and many times on Ebay threads that someone has come along stating they don't claim their income from internet sales.  Most were earning under 20k.  And some more if it was before the newer rule for the 1099's.  But either way they were met with opposition here and on Ebay threads.  Most voice their opinions that they were wrong for not claiming the income.
