Groot Sellers Violate eBay's 30-day PreSale Policy

Good Morning Ina,
This is in regard to the numerous illegal listings of Guardian of the Galaxy Funko Pop Dancing Groot on eBay that violate eBay's 30 day PreSale policy. These listings state that the items will ship in December of 2014, which is 90 days not 30 days.

I spent over two hours two weeks ago with four different eBay customer service specialist who took each Seller's item numbers and listing numbers of these items. All reps stated that these items are in direct violation of eBay's policy. Each rep was polite and thanked me for taking the time to report. NEVER AGAIN!!!

Nothing has been done!!! In fact, I am now getting emails from eBay about only four Groots left....Groot on sale, etc.

eBay talks about Buyer satisfaction...well...90 days after the purchase what can anyone do? Why do they let this continue... They have been notified. I even notified a few of the sellers who responded rudely.

I remember when I'd report my direct competitors for rule-violations which gave them an advantage over me.

Very similar to the OP's description... I'd telephone and point out the rule that had been broken... give listing numbers to the CSR, etc. --- The CSR was friendly and sympathetic, but in spite of their promises and assurances, NOTHING would ever be done.

Back then, I was tempted to break the rules myself. I figured that if my competitors could do it without penalty, then eBay must not really care about that particular rule.

But, I always chickened-out. With my luck, eBay's haphazard enforcement would nail ME (and only me) while my competitors were free to run amok doing exactly as they please.

I guess some things never change. Heaven help honest folks.

ebay only punishes small, honest sellers.

fragrancenet has at least 30% of listings without image of the item, they just have a drawing "picture coming soon"  I have reported this numerous times, as it is a violation of ebay rules, cs always agrees, but nothing is never done.  
It takes time to take pics and upload them, but if they can't find a stock pic, they just don't bother.

A couple of years ago I reported, at least a dozen times, a seller who had four accounts and was leaving positive feedback for herself among the accounts. She was doing stuff like "selling" paper bags to herself with local pickup, and then seconds after the sale ended she'd leave positive feedback. The CSRs I reported it to stated the four accounts were held in her name, and they could obviously see the feedback. She was never suspended and none of the feedback was removed. Here was a person blatantly violating eBay's rules yet no one, apparently, cared about it.

What I cant understand is how I would apparently get VERO'd for items that weren't? It drove me nuts....and I kept arguing how do I prove a non-fact? My item was not what they claimed....but they said it was and that was all that mattered....OH...its the same as a buyer saying my item was not as described....OH YEAH...that's it. My word means nothing! But someone elses does....what list do I have to get on to have my opinion or evidence count?

I've had the same problem, although it's been years since my Ebay days. I ordered a "cartoon" video for my daughter, which was listed under Family Videos, and received a PORN video. I contacted both ebay and the seller, never got my money back, never got the duplicates he was fraudulently selling removed. I have since moved on to onlineauction.com for the last several years. I've had phone calls with the owners, the staff, some members - wonderful service and very, very affordable. Wish everyone would jump on it so we could get more variety to sell. Please give it a try.

critters.  I have been on OLA for a couple months.  I have seen nor heard of sightings of a buyer.  Yes, I pay  the founding member, or whatever it is called, fee.

That is actually a rule from the FTC.  Which is why Ebay changed their policy in the first place as it did not comply with the FTC.

Glad someone mentioned onlineauction (OLA).  I'm giving them a try.  After alot of research about eBay alternatives, they struck me as closest to "Old eBay" with several types of auctions as well as fixed price and the wide variety of categories. Speaking to customer service,I feel confident that they are earnest about providing a stable unintrusive platform, working to advertise and get good search rankings, and that they value sellers.

I was I was extremely dismayed by the arrogant, sophomoric attitude that I encountered in emails to Bonanza; my impression is that it's run by a bunch of antisocial techie kids who believe that they can sit back and rake in profits without lifting a finger.   Seems they've already made some bad decisions and been cited for deceptive actions, such as links to Amazon, by members.  That's the last thing I want to deal with; a company whose execs think that even during the lean, start-up years they can sit back and rest on their scheming laurels.  Sounds even worse than eBay.  Also no auctions on the site. Moreover, in the categories I search, I identified exactly the same listings as on eBay, although raised in price a few dollars.

I'm sorry to be off-topic if it offends anyone.  If there is a place to compare pros and cons of alternative sites here, please direct me.  If not, could that be considered?

Groot is one of 5 super-hero characters from Marvel Comics, which has been made into the movie Guardians of Graxia. Basically, he's a huge walking, talking tree. The figures are being sold pre-release on a number of websites external to eBay. The figure itself looks pretty cool. People pre-order them to ensure that they get one before they're all sold out. There are apparently some hard-core collectors of these items.

As for eBay's 30-day pre-order policy, I'm not familiar with that since it has never applied to anything I ever sold on there. But I think the OP and other posters here are pretty much covering that.

Ina and David have a pretty extensive comparison of alternative selling sites here that they do each year. Click on the ratings tab above.

I'm suggesting to everyone to give eCrater a try. That's where I am now. I can't say how sales are going to go. I'm still in the process of setting up. The only complaint I have so far is their horrible shipping matrix, which is the reason I have divided my items there into four separate stores for light, heavier and media mail items. Once I figure out a workaround, I will probably consolidate into one store. So that you can see what their newest templates look like, I have included the link to my main store. The new templates have a much more professional look to them than the old generic ones.

Etsy would be another good site to look at, although in some ways they're turning into a baby eBay. I agree about Bonanza. I haven't been impressed with them either. The only other one I could recommend is Amazon, although they can be draconian at times as well.

If it's auctions you're wanting, then neither eCrater nor any of the others is going to do it. I honestly don't know of an auction site out there that can replace eBay. Still waiting on that one.

Thank you, Grandma_Fish. I honestly thought Groot was referring to some internal eBay thing!

As far as auction sites,,,I totally agree with you. Ebay is the king of the hill...even with all the issues, injustice, complaints, impossible rules for sellers,and drama. If they were ever to fall hard enough, maybe one of the other sites would have a chance. Otherwise, they stand alone. And they know it.

Thanks! I also was clueless on what a Groot was. Sounds kinda like an Ent.


I am slowly adding my heavier items to ecrater, too.  With clothing I am doing a one size fits all shipping price.

One thing I like about eCrater over others is the nice short web address format:  
storename.ecrater.com.    Other than one's own site, all the others have a few more words for people to remember.

Are you going to do Stripe? That is on my list and interested in how long it takes to set up.
