"If eBay got a report that there was a huge heist of " Black & Decker mowers" and they "were being sold on eBay" - that doesnt mean that without looking at serial numbers, you could remove listings because "YOU THINK". In this country (despite eBay thinking THEY make the rules) its still "innocent til proven guilty".

eBay has every right to remove every single Black & Decker item if they choose to do so! eBay is not a local, state or government agency. . .It's their market and they can decide what gets sold there! If it were up to me I would still be selling surplus 50 cal. machine gun barrels, but those were the good old days of the past.

We can SPECULATE all day long but the FACT is we don't know all the facts!

The OP could be under FEDERAL investigation and the hold was placed by the US Government.

Anything is possible when you have 10 of millions of buyers and sellers!

If indeed the OP thinks they have been wronged they should file a complaint.

But when there's more to the story they don't file anything with anyone.

Umm NO

Its called "restraint of free trade". If you let one person sell "apples" then its ok for ALL to sell them.

If eBay gets a "mandate" from law enforcement then thats %100 different thing altogether - but it would never happen.

When you are a "public accomodation" the rules are different then when you are a private enterprise. eBay is a publicly traded company and NOT a private entity.

Your gun parts may or may NOT be controlled by the ATF. eBay (being the 10 watt lightbulb in a box of 100 watt bulbs does it to 1) pretend they are the GOOD guys (see the parts that hurt people didnt come from us) and 2) potential liability issues.

Umm Yes!

A lot of legal items are not allowed to be sold on eBay!

Just because something is legal doesn't mean eBay has to allow the item for sale on THEIR site.

If you doubt this I can give examples. . . . .

42 U.S.C. §2000a(b) .  This section in Title II of the Civil Rights act describes what legally constitutes a “public accommodation” respecting the rights of the public within, but only with respect to creed being denied right to access.  

Problem is, while it defines physical locations engaged in ‘commerce’, from gas stations to museums, even defining ‘commerce’ within that scope, it doesn’t really describe a ‘virtual’ example.  One can only argue it should.  As much of 20th C commerce law needs to as well.

As far as the often quoted ‘innocent until proven guilty’ cry, since when has eBay ever applied any kind of “due process” to its ‘judgements’?  It’s as if there were no language in law that would compel them to.  

Imagine that.

Lot's of chatter on this one and ton's of good advise. Hope you are writing them all down.

Interesting case I had recently with a home service (AHS) - I filed a complaint with the BBB - didn't put much faith in that one but to my surprise they settled it quickly for me. And for free. ($1,100)

So ebay's stealing your money? Let's say someone broke into your house. Their not arrested but you know who did it because it's on your outdoor camera. What are you going to do? Nothing? Just coming here is the same.

Fight like hell - what have you got to lose at this point? I'm pretty sure you don't care about coming back to fleecebay after it's resolved. So. File a police report for fraud against ebay. Call the FBI - it's a cyber crime to defraud you of your funds over the internet.  They have their own division for that and will actually respond. Pretty sure they like to keep track of all ebay's dirty doings. Go to the ebay page on facebook and blast them - daily. They won't respond but copy and paste your post before you post to your own fb page. Ebay will delete your post so make sure you keep it going on your own. I like to find on the internet the crime articles ebay did to the Steiner's and post those links to my fb page as well. Always good for a laugh on ebay but then I have 5,000 fb friends who are easily entertained and shocked at that info. Those 5,000 friends in turn share to their pages. They can not legally steal your legal funds. There's too many other sites to sell on now. My id has been valid for 23 years - 12,000+ feedback and I would never dream of going back to selling with these guys. I sell on another site and NEVER allow my running balance to go over $100 - that's my limit these days on what I'm will to lose.

The seller sold out in 5 minutes

Should eBay release their funds?
