Walmart Seller Loses Appeals of Incomplete-Return Claim

By: Reader

Dear Ina,
I have an issue that I was hoping your readers could give some advice. I sold a new item on Walmart marketplace for $699 and the customer returned the item back to me as no longer needed. When I received the item back, it only included part of the package. It was missing most of the components including the original packaging and parts inside, leaving me an unsellable item.

I immediately contacted Walmart support to report this issue, but they told me I needed to refund the customer first before issuing a dispute. I am on auto returns with Walmart.

After the refund was issued, I contacted Walmart support again to dispute the return and provided required images of the shipping packing and what was returned. I was denied. I tried appealing the decision 3 times with Walmart and asking them specifically why they denied the claim and refunded the customer. Walmart would only respond claim denied with no explanation.

Since I am unable to call Walmart to find out why and how to prevent something like this in the future. It is clear the customer did fraud and kept the items in the package they want. I did try reaching out to the customer at the beginning with no response.

Just wondering if any of your readers have any suggestions on how to prevent this or a way to contact Walmart support by phone. It appears to me that I have no support from Walmart and it concerns me this could happen again.

Thanks in advance,
Dave

All sellers, regardless of size or circumstance, need to be prepared to report and prosecute fraud on their own behalf whenever their ‘venue’ of choice neglects or refuses to.  That might include filing suit against the venue itself, should they be in violation of their own terms.

These venues don’t care about you or your stuff.

Just another example of why sellers should avoid Walmart Marketplace. Their "seller support" is worthless and you have NO SELLER PROTECTIONS selling on Walmart Marketplace.

Sellers still haven't learned that selling on all of these sites is a crap shot at best. NONE of them have any seller support. They own their playground and any decision they make is theirs. There is no rule or law that says they have to tell the seller why you just got screwed. If you can't afford to lose the item your trying to sell then you shouldn't be selling on one of these sites. As a side note. Your buyer is grinning from ear to ear as they just stole something from you and Walmart says its legal.

when you do not have the financial means to file suit, i suggest what is the wisest of them all. Report them to postal service for mail/wire fraud... Because that person is doing it to others and the postal service sees all that arrives at their doorstep.  And the marketplaces do not want that  to rise to the top because they can't suppress that data point.  Do not negotiate with your captors

Don't assume the post office cares. Their track record is worst than these platforms. Stuff like this is just a bother to them. They have way important things to do according to them BUT they won't tell what they are. Best rule to follow is if you can't afford to lose it then don't sell in on anything but your own website.

File a complaint with the FBI's internet fraud department. Find the police department that covers your buyer's residence and file a theft report. File a Small Claims complaint with the Court that covers your area and carefully follow the rules about service. Does the buyer have Social Media accounts (Facebook, Instagram)? Start posting to his account with photos. And as GetAGrip stated, never list anything on a marketplace like Walmart, eBay, Amazon, that you can't afford to lose (merchandise, money) because it's rare that you will get any help.

iheartjacksparrow is giving the best advice here.

And don't take any advice from gloom and doom "woe is you"  posters here who offer no sound advice. Or those who suggest revenge.

Walmart has no way to tell who is telling the truth-you or your buyer,so you lose.
But it will be on your buyer record,do it too many times,he will be blocked from buying on WMT.

It is not just WMT,it is also Ebay as well,it has no way of telling who is telling the truth, hence the saying DONT SELL ANYTHING YOU CANT AFFORD TO LOSE.
Two cases a few years ago-
A florida antique watch shop sells on Ebay, sold a $45K pocket watch to someone in Midwest, shipped Fed Exp with third party insurance.
Buyer wants to return the item,so they issued a return tag with no insurance.
When Fed Exp delivered the item, they notice weight is lighter so they called the police and open the package, then filed a police report.
Then they reached out to Ebay and Ebay said refund in 3 days else we will do it for you AND take it up with Fed Exp.
Fed Exp does not offer insurance, only indemnity $1k for jewelry and $100 for others.
Second case is worse, buyer paid with paypal $47K watch using his Paypal account with no ship to address as he used it for digital goods.
He asked the seller to ship to an address, seller did ,ignoring the fact that TO qualify for Paypal seller protection,he must ship to the address on the Paypal email.
Since his ship to address is blank, seller lost the case.
Now in this case, seller could have insured the package, but he did not,why ?    .

For buyer there is INR and INAD protection, but I dont believe there is INAD-item not as described protection for seller ,there are some occasions if you are a good seller ,the payment processor or sales venue will just reimburse you out of its own pocket.
Can someone confirm such?

Just another example of why sellers should avoid Walmart Marketplace. Their "seller support" is worthless and you have NO SELLER PROTECTIONS selling on Walmart Marketplace.
--------
Ebay would do the same ,but if the buyer keeps doing this, his buying privilege would be suspended by Ebay.
There is no INAD (ITEM NOT AS DESCRIBED) protection for seller, only for buyer.
