How Feds Can Seize USPS Priority Mail Express Packages

The most interesting part is at 1:58. The US Postal Inspection Service, the law enforcement arm of the US Postal Service, claimed the following reasons were sufficient to seize, open, and inspect the contents of a Priority Express Mail parcel:

- Bulging contents
- Frequently mailed parcels from the same name/address
- Taped or glued on all seams
- Parcel destination is a known drug trafficking area
- Parcel mailed from a known drug source area

USPS Priority Express Mail is considered to be constitutionally protected against opening and inspection without a warrant. So is First Class and Priority Mail.

But in this case, using criteria they use so frequently that they have codes for them; criteria that almost all parcels shipped by online sellers would meet; and criteria that many parcels to and from online sellers and buyers would meet; the Postal Inspection Service illegally opened this parcel.

Sellers better watch out if they're frequent USPS shipping customers, or ship a bulging parcel, or tape all the seams, or they're in a bad neighborhood or shipping to one.  USPIS seems to think that's sufficient grounds to seize a parcel.

"Taped or glued on all seams"
But if you leave seams open, the packages get caught on machines and torn open.  So, your first class, priority, and express mail packages cannot be opened without a warrant unless the seams are all taped AND the seams are not all taped.  Typical government!

There are literally millions of packages sent with one or more of the ‘criteria’ listed as justifications for seizure, every day.  This doesn’t mean yours will be automatically ‘suspect’ for any of those reasons alone.  This is nothing more than a list of what could be thought of as ‘probable cause’, should he question arise at the back end of any investigation that results in a ‘law based’ accusation.

As for the ‘tape seam’ question, especially if ‘excessive’, it’s a technique often attempted to mask odors.  Meanwhile, because of the increase in persons using the USPS as their ‘mule’, many more are eyeballed than in years past, but it is still rare to have an actual ‘seizure’.   Even so, they probably only actually ‘catch’ a low single digit percentage.

No question there are some pretty strange folk that seem to have ensconced themselves here though.

When I ship something in its retail box I wrap in plastic 100%, usually black, and tape 100%. That way a porch thief cannot see what it is and the customer gets the retail package free of a million shipping labels. They definitely look like drugs but don’t care if they open it.

It wold be interesting to know if it was the delivery address that was being monitored and if other packages were being intercepted.  Also, who exactly was responsible for initiating the seizure?  The USPS could have opened, inspected and then finished delivering after finding nothing but face masks and printed product. The Postal Inspection Service illegally opened this parcel but then, they kept it.  This is a disgusting abuse and people should be held accountable.

OK let's say they need a warrant . So they seize the package, request a warrant and wait weeks to get the warrant approved. Meanwhile you have to explain to the buyer why the package was seized awaiting a warrant to open and have no idea how long it will take. Refund please.

First - A quick internet search shows a Rene Quiñonez with a criminal charge in a Springdale High School. I cannot see any way to connect this person to the person who is sueing the USPS. Even if it is, one does not lose their rights to illegal search and seizure because of a criminal record.

Second - Sending many packages from the same address/location and using a common sized brown box. This is most small and large businesses and many US residents. Not a reason to seize a package.

Third - another reason for me to discontinue using USPS. I stopped using them to ship tubes, cubes, and packages in excess of 22 inches long because of the surcharges. Looks like the only thing I am going to be sending via USPS is standard letters. Everything else will not go through UPS, DHL or FedEx.
