Dear Ina,
I was seeing if y'all had any information on lawyers for an (eBay) Vero violation, where the company improperly pulled my items? They pulled about 20 listings for counterfeit and they're authentic.

I’m interested too! I am considering suing an international law firm with over 900 attorneys. I can take them to small claims court since they falsely claimed that an item I was selling was counterfeit. The listing was removed by VERO during the pandemic lockdown (guess they had a lot of time on their hands) and it resulted in damages and a loss in sales during a very busy time. The vintage item is authentic but the idiot attorneys in the EU had never heard of  “first sale doctrine” and claimed that they owned something I had already paid for.

Im not a lawyer - my brother in law is - I just wrote the brief that he looked over then put on his letterhead.

All this depends on how much you want to spend (in my case it was not much since it was family) and what you REALY want to get out of it.

If you are trying to make a point - thats one thing

if you are trying to get the items reinstated, thats another

If you are trying to (re) list these and then list more - thats yet another thing

1) dont relist them till you have a plan. eBay views this as you rubbing their noses in the manure that is an incorrect VERO takedown

2) if you arent making alot of money on these items and they are not your bread and butter, take the lumps and sell them on Mercari - as the cost to prove a point can be expensive

3) there will ALWAYS be horses behinds manufacturers who will burn through thousands if not millions of dollars to make sure a seller cant sell their precious item on a venue they dont like.

4) you cant sue eBay since they will drain your wallet (they are the most corrupt people on the industry - they have NO FLOOR - they will take you to the cleaners - not worth the effort)

5) you need a lawyers letter and the proof you are in the right.

The contact info for this maker is in the email - find a lawyer and go through the steps.

Finding an IP lawyer is very hard - mine wasnt IP - he was real estate - but wanted to help.

NO clue what one would charge - again thats a business decision that you yourself must make.

PERSONALLY, I enjoy fighting the evil empire - and so far their stock went from 75-45 - and thats a victory EVERYONE can enjoy.

@B (the OP) - Reading Pace's comments got me thinking. Do you have a Lawyer Referral Service in the city/county where you live? They would be able to secure an appointment with an attorney who might be able to help you, and you'd only have to pay a minimal fee for the consultation. If you don't hire the attorney, at least s/he could give you some ideas on how to attack the situation. Another option is to go to the Bar Association website for the state you live in and search through the member attorneys to see if any have VERO expertise.

You should also think about whether you want to continue selling on eBay after this issue with them. If you put up a fight, they could take retaliatory action against you, such as permanently hiding your merchandise. You don't indicate what you sell, but there are plenty of other marketplaces on the internet to list your items. Or even better, start your own site where your listings won't be unfairly taken down.

Regarding hiring the right lawyer for the job, a small company I worked for in the late 70's took, one of our dealers to court.  We had developed a fully-integrated accounting software package for Ohio Scientific microcomputers, and a dealer was pirating it.  It sold for about $2,500, and he sold a lot of them but simply copied the diskettes from us to do so rather than paying us the $1,800 for each package.  We had plenty of evidence, having done a "sting"  on him, and I as lead programmer went  through our code and his code in preparing evidence.

In those days you either hired a programmer and sent him to law school or taught a lawyer about programmer, but we found copyright attorneys in Chicago that were as close as possible.  We won, but it was a hollow win as the guy filed bankruptcy and we all went home.  I'm sure the pirate is gone now, but it was a learning process, and an expensive one at that.

I'd simply look at Mercari or some other venue now!  Good luck!

You don't go after ebay, you go after the VeRO member and you do it in your local federal court so they have the cost to come to you.  Loser pays all court fees and attorney costs, and can be hit with trebled damages.  Most VeRO abusers back down quickly when threaten with that, so first just have your attorney write a letter to the VeRO member with a copy to ebay's legal department.

If it goes further, depending on the item and company, look for a public advocacy group that might be able to help.

Sue for defamation. Since EBAY took down your items on their unverified claims it shows that their lies were believed, and you suffered damages. You just need to figure out how much you can go after them for and that's where the lawyer steps in.
