PanAm Collectible Encounters Turbulence on Way to eBay Buyer

Dear Ina,
Just wanted to pass this bizarre shipping scenario I recently encountered, thanks to eBay. I sold several valuable PanAm collectibles last weekend to a single buyer, with the order totaling over $1,XXX. Due to the size/weight of the package, it was more economical to ship via FEDEX Ground than the USPS, so I packed everything up, generated a FEDEX label with signature confirmation and insurance through eBay, and dropped the package off at my local pick-up point on Monday afternoon. 

The package reached its intended destination Thursday, delivery was attempted (no one home), so the package was returned to the local sorting facility. 

Delivery was attempted again the next day (no one home again), so that's two attempts. 

The recipient was concerned that he might miss the third and final attempt (he lives alone and works six days per week), so he called FEDEX to have the package held at the local facility. They would not do it "due to restrictions on the account". He panicked, contacted me through eBay, and implored me for help. 

I called FEDEX, requested the package be held, and was given the same answer. I asked if the package could be re-routed instead to a local FEDEX Office center (there are two within 5 minutes of his home) and they said no to this is well. If the buyer misses the third attempt tomorrow, the FEDEX rep says that the package will be held on Monday & Tuesday for the buyer at the facility and will be shipped back to me if it's not picked up by the end of Tuesday.

I suspect that when eBay negotiated the "preferred rate" with FEDEX for their sellers, it must have included stripped down service amenities, including NO package holds or re-routes. 

I can understand eBay not wanting packages being re-routed due to potential fraud, but being able to have the package held at the local facility seems like it would be much safer than risk a package being left at the door, as an ID must be presented when picking up packages at any FEDEX facility. 

Just wanted to share this with you, as I will think twice now before generating FEDEX labels through eBay to save a few $$ and may opt to use my Shipstation or Parcel Pro account instead.

The terminal must be the back of the drivers truck or they don't have a real pick up spot for that area if they would not hold it.

It does seem pretty silly for FedEx to not hold for pickup at the local facility, but that they would after the 3rd & final attempt before shipping back to you.

Your Pan Am collectibles business also once again brought to mind that 2014 Atlantic article which prominently featured a Chinese knockoff Pan Am tote bag in the article about eBay's (and then-marketplace president, Devin Wenig) sharing buyer data with China.

In addition to eBay's massive investment in Fuzhou, China last year, eBay at the end of October entered into another eBay-China partnership "to better serve and expand the effect of the upcoming second China International Import Expo."

Ebay's new China partnership will provide "financial services, exhibition and trade centers as well as train professionals for cross-border eCommerce" and establish an "innovation, entrepreneurship and R&D center to mainly boost e-commerce export trade."

That sure sounds an awful lot like eBay competing with their sellers.

My first thought when I saw the headline was the OP's letter was about eBay facilitating the counterfeiting of PanAm merchandise by the Chinese (as mentioned by unsuckEBAY).

Just found this tidbit of info.
Read the last line!
Did eBay pay to use those rights?
Maybe, maybe not. . .
But chances are they did, with so many lawyers on hand I doubt they would steal a trademark. . .


Pan Am Systems, formerly Guilford Transportation Industries, a RAILROAD based in Portsmouth, NH.

Guilford acquired the name when they acquired Boston-Maine Airways, DBA PanAm Clipper Connection (loosely related to the Boston and Maine Railroad, which Guilford acquired in the 1980's). The airline operated 727s and Jetstreams on a charter basis until 2008 when the FAA shut them down because (and this part is great) the airline "does not possess the managerial competence to conduct any air transportation operations".

Guilford's railroad enterprise had a similarly poor reputation at the time, so they re-branded using the PanAm name. There are now hundreds of locomotives and box cars rolling around the US with the PanAm globe painted on them. Guilford makes a little money on the side licensing the use of the logo for vintage bags and airline-related paraphernalia.

If you have a license then you dont need to make "INSPIRED" items - your acquisition of the license makes your items REAL - just not vintage.

"We send [manufacturers] data about what people are looking for on eBay and they respond and turn it around incredibly quickly," president of eBay Marketplaces Devin Wenig told me. "We have a really big China export business to Europe and the United States. And they respond very, very quickly to consumer taste, whatever it might be. It's really remarkable to see how quickly the manufacturing base adapts to the demand signals they get."

That's from an August 6, 2014, article in The Atlantic. At no time does Devin ever say that eBay or their Chinese manufacturing partners are licensing anything. How about you proving that eBay has paid for the rights?

Usually you hear thru legal channels when wrong doing is done!

But you never hear when it's done legit.

If eBay stole anyone's rights it would be FRONT page news.

How about YOU proving eBay's guilt?

I wouldn't think Ebay needs a license for anything unless they are the one's doing the manufacturing. That is on the maker and the company selling the items.

Where eBay is implicit is in the providing of data to "suggest" items that may be profitable to reproduce. They also seem to provide some form of funding and or support to bring those items to market.

They are essentially supporting the production of the items, without really being the manufacturer and or owner of them. Sound familiar?  

They may be accomplices in counterfeiting at best. Is that a crime?? I don't know but they probably figured a way to keep their hands clean. I assume they hold meetings and all other dealings within China, so as to be outside the jurisdiction of US laws.

Very clever, and sneaky.

eBay has been supplying most-searched data to Chinese manufacturers for YEARS. Then they produce knock-offs and counterfeits of popular items to sell on eBay. The problem is eBay 100% supports and promotes this fraud onto it's buyers. Location abuse is rampant. Same sellers use many different ID's. eBay consistently scrubs their negative feedback, as they also do for big brands. If it involves money, eBay will lie, cheat, steal, and scheme for it and they need it right now. Zero look into the future. Why should eBay care about long-time customers leaving by the thousands? Their business practices are not sustainable and they're on the road to failure.

eBay has been going out of business for 20 years!

How long do YOU think eBay has left?

OP, for something THAT valuable ($1000) it would seem the buyer would want it delivered to his job; or to a secure lockbox; or to a FEDEX OFFICE CENTER for pickup.  I know if I had a $1000 valuable item coming, I would track it and know when it's being delivered.  Your buyer loses.

My own thoughts are that YOUR BUYER's FedEx reputation OR the reputation of HIS ADDRESS might be the STOPPER that is holding up delivery.
IF IF IF this guy is a SERIAL FRAUDSTER who files BOGUS insurance claims against FedEx time and again HIS "ACCOUNT" might be the problem.

Probably a function of the declared value.  I know that if you declare the value as being $500 or more then a direct signature is forced - presumably a requirement imposed by the insurance carrier.

Maybe this package was declared at over $1000 which may also have added the limitation that redirection was not permitted.

I don't think that it is anything to do with eBay.
