eBay Has a China Returns Problem that Impacts Buyers

Dear Ina,
Buyer beware on power tool batteries. Knockoffs are made to look nearly like name-brand and use the brand in listings. Many have been fooled.

An eBay search by brand name will still get you knockoffs. At least on Amazon, right under title it will show who made it, such as by Milwaukee or by Vanon. 

The problem arose after eBay guarantee expired. eBay would do nothing. PayPal said I'd have to return to get refund. When I received address, it was in China. Shipping alone was nearly double what I paid total. 

Got same response from Citi card. They would do nothing unless I returned them. 

Total worthless warranty and in my opinion deceptive ad. Bought from US but have to ship to China to get refund or replacement. Make sure you are dealing with US seller and not a foreign seller warehousing in US.

It has always been this way. Ebay's policies read that the buyer is only responsible for returning the item to the location listed in the listing. Paypal policies state that you are responsible for returning the item, with tracking, to the location listed by the Seller.  So if your seller's location is in China, then THAT is where you must return the item to. Has always been this way. That is why you must check the Seller location on the ebay feedback page. This is why many of us do not want feedback to go away. Because you KNOW that ebay will never reveal or make searchable, the seller's location. No China seller would sell anything again with their crooked return policies. Buyer beware, just more policies that do not jive between the 2 companies. Will be interesting to see what ebay's Managed Payments program will bring for a SNAD return. They may be shooting their China sellers in the feet, but then again, they may be hiding a policy in there that will protect them after 30 days. Who knows.

It still amazes me that gullible buyers buy from China or China posing as US address for pennies on the dollar and then are surprised when they receive a counterfeit.

ebay and Amazon are all about fake goods, raking in billions of dollars annually. Probably 50% or more of what you buy from these two sites are fakes.

How does anybody not know this by now??

As the Buyer in this situation, the item WAS listed as in the United States. The problem arose after the 60 day return limit, because it didn't need a re-charge until after then. The seller literally told me they would refund, but to do that, I would have to return it to China even though the listing said United States. They knew it would cost most to return it to China than I had originally paid. This item cost $89.58. One use and it was junk.

Savvy ebay buyers know to click on the seller's information. That will generally tell you if the seller is located in China.

If he presented himself as a US seller in all areas then that's fraud. Your CC company should take a second look and rule in your favor.

ebay is aware of this yet does nothing because it would cut into their profits. Amazon is worse. Even if you call them, they will not tell you where the seller is located.

The whole thing is criminal and really needs a federal investigation. But since Amazon and ebay pay so much in taxes to fund federal programs, the feds look the other way too.

America is no longer a country. It's a business.

Ebay actually assists these sellers with the Fraud by helping them find the US warehouses to store the goods which means that a buyer should be able to return the item to that location.  However Ebay allows this fraud to be perpetuated because they are partners with many of these businesses and it would again cut into their profits and if they forced the Chinese sellers to have to give the refunds they would probably lose all those sellers.  Also the Chinese contract is different than anything we have as China will not allow Ebay to track IPA;s so even if Ebay permanently suspends a seller they are back in business with a new name a couple of hours later and there is nothing Ebay can do about it.

This is why Wenig continually says that China is Ebays future, but he fails to realize that the buyers are getting so fed up with it that China is going to cost Ebay much more business than they bring in.

ebay should be sued for some of the nasty china sellers they promote and profit from, some of the items are outright dangerous beyond belief, if you buy from ebay china sellers you must use extreme caution with the items, tons of fake, stuff, ebay is china's dumping ground for the worst stuff made on the planet, even china itself has more laws to protect it's citizens, from it's own fake stuff

If you buy something on ebay and it is listed in the USA, THAT is the only place you are required to return it to, and the seller is totally responsible for the return shipping if it is a case of SNAD.  That is ebay's policy, and if you don't make them uphold it, shame on you.  THAT IS NOT PAYPAL'S POLICY. If you read, you will see that. Paypal requires that buyers pay return shipping, no matter what, and their policy states that you are responsible to return to the Seller's return address (where their account is held).  China sellers are in China with paypal. This is not new.  This has NOTHING to do with ebay.

If the item was shipped from the USA then it should be returned to it's origin, not China. That has everything to do with ebay.

You can boycott china all you want it won't make one bit of difference at this point, 20 years way too late

Don't forget, we gave all our technology and manufacturing to china, and combined with their absolutely huge cheap labor force, they already are the number 1 country in the world in technology as well as military.

Along with the cheap fake stuff, china also produces very high quality items,

A lot of the specialized high tech electronics I use is "ONLY" available from China, it's not even available in the USA, or anywhere else, for that mater other then china.

It's not even close!

The US has 10 aircraft carriers, china has 2. . .They got their 1st one operational 5 years ago, we've been sailing aircraft carriers for over 100 years!

We have F-22 & F35 Stealth Aircraft, the chinese have J-10 with 4th generation engines and inferior avionics. . .

The only thing china has over the US is the shear number of standing soldiers.

They have ZERO combat experience unlike the US Armed Forces.

They even copied our C-17 (Y-20), they DON'T develop anything , they only steal other countries ideas.

FLY in the OINTMENT of using FEEDBACK PAGE to determine if the seller is a DOMESTIC USA seller or SECRETLY from some OTHER Country.
Legitimate ( and/or crooked ) sellers who OPENED their account in ANY foreign country (Think Canada France Germany U.K. Myanmar Yemen Saudi Arabia Russia) who subsequently MOVED to the USA are still listed on their feedback page as STILL in THAT country where they first joined eBay.

The real point has already been addressed by MANY here today.   The RETURN ADDRESS should be the exact same address as the SHIP "from" Address.
Personally, I would LOVE to see AMAZON deluged by eBay Returns when DropShippers used their PRIME account to have Genuinely Defective items shipped to their EBAY customers as GIFTS to Alternative Addresses.

@toolguy - I don't know why you are bringing up how many aircraft carriers or soldiers that China has. We aren't talking military superiority here. We're talking about manufacturing and sales of Chinese-made products. As long as Chinese (Mexican, Vietnamese, etc.) companies pay their workers pennies, while the U.S. has a minimum wage, items manufactured in the U.S. can't compete price-wise with products produced in foreign countries. In looking at a few items I have sitting next to my computer, they were made in India, Mexico, South Korea, and China. You have to realize that a good portion of the U.S. population simply does not have the financial ability to purchase items made in this country.

@Just plain irritated:  You should flood your Secretary of State's Consumer Division with complaints.  They accept "scams" and other frauds.  You should also complain to the BBB.  If the seller was fraudulently listed as in the US and was in China, that warrants complaints to both your SOS and the BBB.  YOU shouldn't have to pay 1/2 the price to ship back.

We forget that many US manufacturers develop and make their products overseas then import them here. Or they import components from overseas and assemble the final product here. Or they simply finish a small part of the product here (The instruction manual for example).
When we see "Made in the USA" on the label it means little to nothing anymore.
Then there's Proudly made in the USA, which means we have made most of it here, but some parts still come from overseas...and so on and so forth.

Go back to Citi and tell them you wish to open a charge back using reason code 53, I PROMISE you you will win the charge-back.  

This charge-back code cover a variety of reasons but the one you will probably win over is that the terms of sale were misrepresented, ie that the items were shipped from within the USA and the items were returnable to the seller in the USA.  Since the items were actually shipped from China and the seller expects you to return the items to China, the original terms of the sale were misrepresented.

You can do a quick google for the chargeback reason code, but here is a quick over-view......
From the merchant’s point of view, there are a variety of actions that could have lead to a Visa reason code 53 charge-back:

For Products:

   The wrong merchandise was sent to the cardholder.
   The merchandise was damaged during shipment.
   The merchandise’s description was inaccurate.
   An attempt to return the merchandise was not accepted.
   The returned merchandise was accepted, but the cardholder’s account was not credited.
   The merchandise is counterfeit.
   The Terms of Sale were misrepresented.

BTW, a few additional points....
* The MasterCard equivalent is charge-back reason code 85
* According to a very kind and knowledgeable Paypal CSR, a seller will lose a 53 or 85 99.99% of the time since one of the ''conditions'' of the code is the buyer was promised a refund... A seller has no way possible to prove they didn't make that promise.  I actually got a great education about these codes codes as a seller from the above mentioned Paypal rep over a tracked as delivered claim of INR.
* This is the way to stop Chinese (or other international) sellers from misrepresenting the location of their merchandise.  

I think I failed to mention that they also get hit with a $20.00 charge-back fee no matter the cost of the purchase.... Hit em in the pocket-book enough times and it will no longer be profitable to pull this crap.

I'm hoping it may assist the OP with his/her situation... follow through and you will prevail.

Often we BLAME eBay, when the problem is the programmed AI eBay used! Now I am not going to defend eBay, because their programmers are in India and frankly they don't care and are sloppy; low bid contractors. Certain know issues have existed for many years and the search system is obsolete! eBay uses titles, descriptions and categories all at one time to return to you 4,000 returns of which only 10% is actually what you want. WTH, who has time for that? the letter i is NOT a number on a keyboard, DON'T use it , if you are trying to list in the title a numeral number. Roman numerals ended in 568 AD, dont use the L lower case as a number. Why you may be thinking; well buyers use alpha numeric numbers. So lllb, iiib and 3b return  totally different searches and as a seller your screwed. If you dont believe me, try for your self and see the difference. eBay needs to search by Title ONLY. If the Seller didn't get it right in the Title, it's their own darn fault for being stupid and NOT doing their homework first. Many items on eBay are listed incorrectly and a keen seasoned buyer/seller can spot the stupidity very fast. Good sellers do their homework! If i buy from China, I wait for as long as it takes, knowing full well, I am never returning the item.
