Germany Cracks Down on Amazon Sellers from China

German tax authorities have cracked down on Chinese merchants selling on Amazon, according to Mark Steier of German ecommerce publication Wortfilter. 

"From China came the news that on Thursday, 28 December 2017, many large Chinese traders were suspended from Amazon. de. They received a message from Amazon indicating that the German tax office is targeting the illegal third-country traders on Amazon. The merchants were suspended, their FBA inventory and Amazon Payments were confiscated."

Steier said it appears to affect only larger merchants and said Amazon has suspended their accounts and will not return inventory in its warehouses, nor will it release any funds, thanks to German tax authorities.

His sources say Chinese merchants are panicked, and he's working on getting a list of merchants who were impacted by the crackdown.

They should do that here, but eBay wants the Chinese.  If they did this here, it would completely change the entire landscape of ecommerce.  We would start making money again!

Bought a copy of Office2010 the other day on eBay.  Was priced about $8 less than most & free shipping.  Listed as English language, sealed package, good for 3 computers.  Description was not written in "pigeon-English", but good English.

This was for a multi-quantity listing of 4 - 3 Sold, this was the last one.

eBay Seller location listed as Perkasie, PA.  Checked Seller ID and listed as "Member since: Jul-07-03 in United States."  59 Feedbacks, 100% Positive, only 7 in last year - for shoes, perfume and books, all more than year old.

Decided to try it anyway.

PayPal receipt arrived in my email, listing PayPal address I paid to as xxx@mail.ru.  Russia.  Didn't have sales tax assessed - shouldn't have as I am in Ohio and purported location is Pennsylvania.

Tracking number posted to eBay is International, and tracking now says item processed through Zhengzhou.

In checking elsewhere on eBay for more copies of Office2010, I see the same picture listed in an auction with a location now of Texas.  Same price, same description, same picture.  Now 10 copies, 1 sold.

I think I'll start a poll.

1. How many think I'll actually get something in the mail (not necessarily a copy of Office2010)?

2. How many think I'll get a COUNTERFEIT copy of Office2010?

3. How many think eBay will do NOTHING, other than maybe refund my money if #2 proves to be correct?  (And then I'll have to fight them for it).

Sorry, can't provide prizes for the winners of this sweepstakes, I'm too busy spending 5 times as many hours (now 60-70 hrs per week) listing on eBay to try to keep up my required flow of income so I don't lose my house.

eBay should be in fear of losing THEIR house by providing cover and support for probable scams like this.  I'm thinking these are hijacked accounts.  For which eBay will do nothing other than waste my time on the phone with them trying to report them.

Good work Germany thats awesome.

Having chinese sell direct is amazingly stupid as it also is like manufacturers competing with their clients. Really dumb to have a chinese warehouse make you something just for them to turn around and sell it cheaper direct. Not to mention all the fakes.

We do not need a global market in this case

This is what the article states:

"Amazon receives notice from German „Steuer Institute“ (i. e. tax office) that you do not meet the requirement of regulation of German sales tax“. You are no longer allowed to sell on Amazon. You may not take back your stock in FBA, because German laws require us to block the goods until you have met the requirement of the German tax office. If you still have credit on your Amazon Payments Europe S. C. A. account, it will be blocked at the request of the German tax office."

Whoa.......interesting but lacking full disclosure.

Appears German tax officials are not afraid to create waves enforcing their laws and reg's.  Good for them.  Maybe our foreign friends will clean up their act a bit in the good ol' US too.

Would appreciate knowing the nitty gritty but doubt we'll be told everything.

I still have questions. Did The Chinese fail to pay sales tax, the VAT, import duty tax or all three?

Are American sellers supposed to pay taxes to Germany or any other EU country?  

Why aren't the buyers responsible for paying these taxes on delivery?

dans parts, if it is coming from Russia and you install it you may get even more than a counterfeit. Your computer may become a machine for Russian hackers.  The USA government got rid of Kaspersky anti-virus software for a reason.  Better safe than sorry.  I'd send it right back. We are living in crazy times right now. Leave nothing to chance.

Businesses are supposed to collect and remit VAT in Germany.  There is also inventory value and others. When I was in business in Germany it was a service business and therefore I did not have to bother with except for VAT.

For casual sellers there are overall limits before being bothered with taxes. My two sons both sell on eBay and their gross is nowhere near tax reporting levels.
