Six Former eBay Employees Charged with Aggressive Cyberstalking Campaign Targeting Natick Couple

BOSTON – Six former employees of eBay, Inc. have been charged with leading a cyberstalking campaign targeting the editor and publisher of a newsletter that eBay executives viewed as critical of the company. The alleged harassment included sending the couple anonymous, threatening messages, disturbing deliveries – including a box of live cockroaches, a funeral wreath and a bloody pig mask – and conducting covert surveillance of the victims. 

James Baugh, 45, of San Jose, Calif., eBay’s former Senior Director of Safety & Security, was arrested today and charged by criminal complaint with conspiracy to commit cyberstalking and conspiracy to tamper with witnesses.

David Harville, 48, of New York City, eBay’s former Director of Global Resiliency, was arrested this morning in New York City on the same charges and will make an initial appearance via videoconference in U.S. District Court in the Southern District of New York.

In addition the following defendants were charged in an Information unsealed today: Stephanie Popp, 32, of San Jose, eBay’s former Senior Manager of Global Intelligence; Stephanie Stockwell, 26, of Redwood City, Calif., the former manager of eBay’s Global Intelligence Center (GIC); Veronica Zea, 26, of San Jose, a former eBay contractor who worked as an intelligence analyst in the GIC; and Brian Gilbert, 51, of San Jose, a former Senior Manager of Special Operations for eBay’s Global Security Team. They are each charged with  conspiracy to commit cyberstalking and conspiracy to tamper with witnesses and will make appearances in federal court in Boston at a later date. 

According to the charging documents, the victims of the cyberstalking campaign were a Natick couple who are the editor and publisher of an online newsletter that covers ecommerce companies, including eBay, a multinational ecommerce business that offers platforms for consumer-to-consumer and business-to-consumer transactions. Members of the executive leadership team at eBay followed the newsletter’s posts, often taking issue with its content and the anonymous comments underneath the editor’s stories. 

It is alleged that in August 2019, after the newsletter published an article about litigation involving eBay, two members of eBay’s executive leadership team sent or forwarded text messages suggesting that it was time to “take down” the newsletter’s editor.

In response, Baugh, Harville, Popp, Gilbert, Zea, Stockwell, and others allegedly executed a three-part harassment campaign. Among other things, several of the defendants ordered anonymous and disturbing deliveries to the victims’ home, including a preserved fetal pig, a bloody pig Halloween mask, a funeral wreath, a book on surviving the loss of a spouse, and pornography – the last of these addressed to the newsletter’s publisher but sent to his neighbors’ homes.

As part of the second phase of the campaign, some of the defendants allegedly sent private Twitter messages and public tweets criticizing the newsletter’s content and threatening to visit the victims in Natick. The documents allege that Baugh, Gilbert, Popp and another eBay security employee planned these messages to become increasingly disturbing, culminating with “doxing” the victims (i.e., publishing their home address). It is alleged that the very same group intended then to have Gilbert, a former Santa Clara police captain, approach the victims with an offer to help stop the harassment that the defendants were secretly causing, in an effort to promote good will towards eBay, generate more favorable coverage in the newsletter, and identify the individuals behind the anonymous comments.

The third phase of the campaign allegedly involved covertly surveilling the victims in their home and community. According to the complaint, Harville and Zea registered for a software development conference to explain their trip to Boston on Aug. 15, 2019. Baugh, Harville, and Zea (and later Popp) allegedly drove to the victims’ home in Natick several times, with Harville and Baugh intending at one point to break into the victims’ garage and install a GPS tracking device on their car. As protection in the event they were stopped by local police, Baugh and Harville allegedly carried false documents purporting to show that they were investigating the victims as “Persons of Interest” who had threatened eBay executives. The victims spotted the surveillance, however, and notified the Natick police, who began to investigate. The police learned that Zea had rented one of the cars used by the defendants and reached out to eBay for assistance.

Aware that the police were investigating, the defendants allegedly sought to interfere with the investigation by lying to the police about eBay’s involvement while pretending to offer the company’s assistance with the harassment, as well as by lying to eBay’s lawyers about their involvement. At one point, for example, Baugh, Gilbert, Popp, and Stockwell allegedly plotted to fabricate another eBay “Person of Interest” document that could be offered to the police as a lead on some of the harassing deliveries. As the police and eBay’s lawyers continued to investigate, the defendants allegedly deleted digital evidence that showed their involvement, further obstructing what had by then become a federal investigation.

The charges of conspiracy to commit cyberstalking and conspiracy to tamper with witnesses each carry a sentence of up to five years in prison, three years of supervised release, a fine of up to $250,000 and restitution. Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and other statutory factors.

U.S. Attorney Andrew E. Lelling; Joseph R. Bonavolonta, Special Agent in Charge of the Federal Bureau of Investigation, Boston Field Division; and Natick Chief of Police James G. Hicks made the announcement today. Assistant U.S. Attorneys Seth B. Kosto and David J. D’Addio of Lelling’s Securities, Financial and Cyber Fraud Unit are prosecuting the case. 

The details contained in charging documents are allegations. The defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.

eBay Inc. Issues Statement Regarding Indictments of Previously Terminated Employees

eBay Inc. (NASDAQ: EBAY) today commented on indictments separately announced by the U.S. Attorney's Office in Massachusetts against several former eBay employees. Neither the Company nor any current eBay employee was indicted. In order to preserve the integrity of the government’s investigation, eBay did not previously communicate about this matter. In light of today’s public announcement by the government, eBay is now addressing this matter publicly. 

eBay was notified by law enforcement in August 2019 of suspicious actions by its security personnel toward a blogger, who writes about the Company, and her husband. eBay immediately launched a comprehensive investigation, which was conducted with the assistance of outside legal counsel, Morgan, Lewis & Bockius LLP. As a result of the investigation, eBay terminated all involved employees, including the Company’s former Chief Communications Officer, in September 2019.

The independent special committee formed by eBay’s Board of Directors to oversee the Company’s investigation into this matter said, “eBay took these allegations very seriously from the outset. Upon learning of them, eBay moved quickly to investigate thoroughly and take appropriate action. The Company cooperated fully and extensively with law enforcement authorities throughout the process. eBay does not tolerate this kind of behavior. eBay apologizes to the affected individuals and is sorry that they were subjected to this. eBay holds its employees to high standards of conduct and ethics and will continue to take appropriate action to ensure these standards are followed.”

The Company noted that the internal investigation also examined what role, if any, the Company’s CEO at the time of the incident, Devin Wenig, may have had in this matter. The internal investigation found that, while Mr. Wenig’s communications were inappropriate, there was no evidence that he knew in advance about or authorized the actions that were later directed toward the blogger and her husband. However, as the Company previously announced, there were a number of considerations leading to his departure from the Company.

Know the real irony here?

Had eBay only just treated the “noise” with some dignified respect for the eCom experience it conveyed, and “let go” of their corporate culture of deadly sins for this moment and foreseeable future erroneously claimed “intolerable” - instead of letting go of their foundation and legacy while the ‘directors’ wrist-flicked away operations and myopically focused on algorithms improperly applied and profits improperly obtained - this blog would contain and convey a whole different menagerie indeed.

Instead we mourn for what should be. And curse the reasons for it.

Recode published a piece last night stating, "The eBay security team that allegedly carried out the crimes reported up to WENDY JONES..."

This begs the question why comms Chief WYMER was the one apparently ordering around WENDY JONES' downline report BAUGH?

BAUGH was, "Senior Director of Safety & Security.  BAUGH ran eBay’s Global Security and Resiliency (“GSR”) business, a company division responsible for, in general terms, the physical security of eBay’s employees and facilities worldwide."

I'm sure she's a lovely person, but WENDY JONES has long been on our 'High Risk, Heightened Scrutiny" list, particularly as a result of her receiving ~$11 Million in bonuses in 2018 approved by DEVIN WENIG and the BOD's compensation committee (notably helmed by incoming EBAY chair, PAUL PRESSLER), all the while EBAY was laying off hundreds of employees, experiencing significant technical issues, and undertaking cost-cutting measures (even to include eBay Radio, as reported by ECB).

It's straight-up mafioso tactics (Pace's analogy has never been more apt), with WENIG and WYMER playing the levels with consigliere WYMER 'laying cover' as needed to maintain plausible deniability for "Don" WENIG.

WYMER texted BAUGH (WENDY JONES's report) assuring BAUGH “I"ll embrace managing any bad fall out. We need to STOP [victim 1].” (ss 39 in the complaint).

Sounds like perhaps an attempt to keep this little 'corporate black ops mission' off JONES' department's subject-to-audit paper-trial, what with all the prepaid debit cards and falsified materials (alleged).

There are many great comments here. While I'm glad proof positive of the culture at eBay (et. al) has come to light, it's unfortunate that the dear Steiners had to be the victims. I'm sure many of us can relate on some level, so, their professionalism and perseverance certainly doesn't go unnoticed by us.

It only strengthens our admiration for the two who have provided us this platform to review and comment on the reported facts -- and without fear of reprisal. This whole situation just goes to show how much we've had to fear in our fight against these criminals.

So, hats off and drinks up to you both. I'm sure you will be well rewarded for your troubles, but you will most certainly have our respect. You both have been silent troopers in the plight of American small businesses (and beyond) and we're all happy to have you both on our side. =)

I know there are entire web sites dedicated to exposing Ebay/PayPal corruption, but never heard of this blog before I saw it in the news today.  I just want to say that I have seen this kind of thing going on for a very long time, and it is not limited to the employees they fired... the corruption goes all the way to the top.  And one of the conspirators was also a dirty cop who had been promoted to captain:

that's true enough -- but they did not just happen to be sitting in a meeting where someone said:  ''let's see how we can please Ebay's senior management !''   They were acting on ORDERS to ''stop this bad press'', and  THE FORUMS ARE HEAVILY CENSORED IN THE SAME WAY, AS A MATTER OF COMPANY POLICY.   Concealing corruption is the highest priority for eBay's management, and the people who were charged were not acting on their own.  No one is  that  passionate about protecting a corrupt corporation, unless there are substantial INCENTIVES.  As one of the conspirators stated in a chat on What'sApp:

“I’m going to push the idea that eBay is a massive company and have no interest in the (victims). The idea we would send shit to their house is ridiculous.”

But the conspiracy was real, and the front-line field operatives were only fired  because they got caught .  The company must now pretend that this is a rogue faction which operated without supervision --not a slice of the corporate culture (which it actually is.)  The firing was just political damage control: nothing has changed at Ebay, and it never will -- at least not  voluntarily , for this company has only grown more corrupt, restrictive and abusive with each passing year.  And many others have noticed this too.  As someone said in another forum:

I saw sellers saying the horrible things Ebay did to them for speaking out. And few believed them. But I did believe them. I felt in my heart that there was truth to what they were saying. There
are many cases where Ebay protected a dishonest seller because he generated a lot of revenue, but abused the smaller, good sellers who had a great reputation.  I have also seen countless cases where PayPal viciously abused an innocent member for the sake of profit or politics.  There is a LOT of unfairness and injustice on this platform, and that is why I only use it as a last resort now, when I cannot buy or sell what I need someplace else.  And that is what I want to talk about here:

How can we break up the Ebay-PayPal monopoly?   Why has no one even tried to organize a resistance movement, when the economic stakes are so high?  We need a trustworthy, reliable platform now more than ever, with so many people out of work, looking for another source of income.  But there cannot be just ONE dominant platform, for there never was a monopoly that served the public well.  Absolute power corrupts absolutely.

Many independent, low-volume sellers of unique items are forced to use Ebay because it has the largest audience of any auction site.  If you want to sell your stuff, you will have to tolerate the company's abuse, dishonesty, and substandard customer service.  Monopoly is the name of the game.  And monopolies are synonymous with organized crime.  It's not just the shameless greed, and forcing PayPal down our throats, and other anti-competitive trade practices.  It's not just the fact that even the smallest PayPal accounts will be frozen on various pretexts (especially if you won't give up your personal phone number):

Time after time, I've also seen forum accounts purged from the system because they demonstrated proof of corruption or gross incompetence.  I've seen this happen often enough to notice that  the company has censors working around the clock to conceal its crimes and mistakes.   The really damning complaints do not last a day.  That's what ''intelligence'' is all about -- not just on Ebay, but ALL THROUGH THE GOVERNMENT TOO.  Even some state governors have a team of ''assistants'' who monitor the media in order to find and harass critics of the administration.  There is no such thing as freedom of speech: ALL speech can be punished in some way, unless it is anonymous.  Only then can you speak without fear of retribution from psychopaths.

This
really is a form of insanity: it never occurs to the management that Ebay could make MORE money by providing fair treatment and quality service.  In the long run, it is far more costly to earn a bad reputation and then hire people to try and cover it up.  Word still gets around, and members just walk away when you ignore their complaints.  This kind of strategy makes no sense.  But that's what crazy is: insatiable greed is a real mental illness, and it propagates from the top down.  The tighter they squeeze, the more will slip through their fingers.  They just don't care about the ''little guy'' -- but millions of those little guys can make or break the platform's success.

Notice how these Ebay conspirators were all working in a department called ''Ebay intelligence.''  Of course you get the obvious joke,  ''they don't seem too intelligent to me.''   Ebay does not NEED an intelligence agency -- it needs a department of COMMON SENSE and COMPLAINT RESOLUTION.  All of the money which they spent on spying & dirty tricks should have been spent on customer service (which frequently ranges from horrible to non-existent.)

What happened here is a microscopic example of the deep state:   Ebay would LOVE to murder its critics, IF IT COULD DO SO WITHOUT BEING CAUGHT.    And the government DOES get away with such things.  It also uses the surveillance grid for political & industrial espionage, on a daily basis.  The government sponsors terrorism to justify this surveillance and ''protection.''  It's all about cultivating invisible monopolies.  If you want to understand corporate culture, study the secret government.  Ebay/PayPal is the corporate mafia, and what you've heard about them in the news is just the tip of the iceberg.  So now that I have set forth the problem, again I ask:     What can we do to bust this monopoly?     A revolution, of course:  E-commerce sites should all ''hang together'' so they don't hang separately.  Team up against the bully -- it is as simple as that!

If all of Ebay's competitors would agree to implement a standard API for product search queries, you could make a ''universal auction app'' that would search ALL related sites simultaneously, and combine the results.  This would allow other sites to compete with Ebay on a level playing field.   Soon everyone would be using the app, because you would get better search results from multiple e-commerce platforms.  We would then be free to use a service that treats the customer with respect, instead of being tied to the one with the largest user base.  This is the ONLY incentive that Ebay will ever have to clean up its act -- and we need to promote this solution HARD, educating people at every possible opportunity.  That is basically what happened to ''America Online'' when the internet came along:

The
service sucked, and it was too restrictive.  People were only willing to use it so long as they had no practical alternative.  The company just collapsed when the internet enabled meaningful competition.  Ebay sucks in much the same way: a relatively decent platform was sold to corporate gangsters who basically ruined it with unnecessary regulations and policies which are enforced in an unjust & inconsistent fashion.  People don't like Ebay anymore -- they merely tolerate it, and pray that nothing bad happens to THEM.  They will QUICKLY abandon the platform as soon as a credible alternative emerges.

You cannot cure this industrial disease, because you cannot cure a psychopath: they cannot conceive of a situation where corruption will fail to achieve their goals sooner or later, so they never enact sincere & meaningful reforms.  Ebay & PayPal must be put down, for the good of the community.  The best way to do that is by creating an authentic free market where corrupt companies die a natural death when they decide that abusing customers and attacking critics is the best way to increase profit margins.  Those gangsters did not know it at the time, but the funeral they planned is going to be for Ebay & PayPal.  Even if the company survives, they have unwittingly started the process that will end their tyrannical domination of this market.

Ebay can try to tell us this was a rogue group, but according to the Reddit post from 7 months ago, it was way more than the 6 indicted and Wenig fired. Anyone with any knowledge were secretly let go, even some who were no involved, but happened to see a memo that was not supposed to go out to everyone.

But that also tells me that dozens of people knew, and not one of them went to the police, thus the mafia like culture they railed against in the eBay Tower was completely true.

@ECM...Firstly, let me thank you for taking the top spot on the longest post ever on these boards (coming from one of those who was at the top at some point, if not still). LOL Secondly, I would just like to add that eBay is NOT the only site guilty of the culture you're referring to.

May I remind everyone that Etsy inherited one of their thugs for their latest CEO; intentionally hired by their BOD to replace the former @$$wipe. It's like Romper Room on Wall Street where everybody is playing musical chairs. Only the meanest, nastiest thugs who will knock you off a chair just so they don't lose get the dream jobs. Yes, I can literally envision them choosing their executives in such a manner.

Adding to what The End said...Those of us who have been selling at eCrater all these years have been waiting for it to have its day in the spotlight...a positive light. That's because we all know they're the only ones who actually deserve it and based solely on the relationship they choose to have with their customers (sellers)...the hands-off, but helpful kind.

Who cares if they don't have all the bells and whistles like other sites. Did those ever work properly, anyway? At least on eCrater, you're free to run your business as you see fit without paying a dime unless something sells (2.9%). With such a low FVF, that frees up funds for other things like marketing and, oh yeah, food.

Well ....10,9,8,7 ..... it will happen - its just a matter of WHEN not IF someone will say it.

While the issue here is eBays criminal treatment of 2 nice people, their business and their families (OF COURSE) ... there IS a larger picture here - some have touched on it and some have not.

Obviously job #1 is again reiterate how appalling eBays behavior is/was to the Steiners. Theres ZERO excuses, especially from people high up in the company - especially Wenig - whos head should be on a pike for it all. He knew about it, sanctioned it and woulkd have gone through with it all, had they "not got caught". THEN he ran away (like a child) and said "it was them not me". BS

But, job #2 is the insidious culture that is and has become eBay.

eBay is "Death by 1000 cuts" .... and here (the cheeleaders who cant differentiate good from bad and right from wrong) and the idiots on Youtube (whom eBay pays off to evangelize for them) tell anyone who will listen that what ever eBay does is good and right, when common sense and basic humanity tells you otherwise.

Stealing from sellers is just as bad as stealing from buyers. Theres no ifs ands or buts. Theres ZERO rational that says its ok. It doesnt matter if its Wenig, the dopes from Walmart, the BOD, or anything else - its still wrong. The cop out of "well how do you expect eBay to know whos telling the truth" doesnt work. If eBay whos worth $5 billion, cant figure it out - then stay out of it. Using the BS line "well its business and in business you take losses to heres one - tough luck" DOESNT work. I highly doubt the cheerleaders would like if it happened to them (on eBay or irl).

What the deal with the Grifter? Hes supposedly the head of "seller protection" - ok can you show me some PLEASE? Ive "ONLY" been here since 1998 - and Ive never seen any - can I pleases see some? Nah - easier to try and lie to sellers and tell them that eBay has your back and that selling on eBay is like (since eBay "lets you") "run your own business" - after all - they are "just a venue" like they swore in court. I dont want 30 day returns - and if its MY business then LISTEN to me.

But since stealing doesnt bother anyone - why should lieing?

How about outright FRAUD?

Whether its lieing and telling the Feds that you are ACTIVELY working to stamp out fakes, or you take bribes to hand over lists of sellers to companies so that they can fake VERO them, or cheat on your taxes by claiming "all sales are from San Jose" (thereby cheating other CA jurisdictions of tax monies they may need), or ripping off sellers by charging them a fee to collect sales tax - something they got paid for and is illegal - theres NO FLOOR for a company such as this.

Im not suprised at eBays behavior - Id have guessed they would do WORSE - just they got caught.

Thank God they didnt.

eBay IS the San Jose Mafia - there isnt an honest person in the place - but if you think Im wrong - go try and get some seller protection, go try and win a fake SNAD, go try and fight for charges on your account that were put there "by mistake all the time" - go right ahead and try.

Each an d every part of eBay is some kind of microfraud - what a shame and embarrassment!

I also just wanted to say thank you for the efforts you have put in for the extensive research and the very more detailed information that you provide for all of us here.
It is a true gift that you have and thanks for sharing it with us!
I wish that there could be a business that you have that polices the malpractices from these platforms because now it seems like everyone else is trying to set this awful standard.

This is ALOT of hard work that I both respect and appreciate, and I am glad to see that you have finally cracked the armor that is corporate cowardness.

For the record, I also admire the many other posts from the regulars here, but I wanted to thank these two exclusively for all of the information they provided.

So many posters on many other sites had the same complaints about d-bay, and few ''cheerleaders'' were defending it, insulting us, and eventually banning us from expressing each individual truth from our own experiences.

All this from little overpaid punks who don't know how to operate any business.
Collecting ill-gotten paychecks from licking boots.  This is what d-bay invested in, this is why they suck.

am a fairly new seller, and left ebay in 2018 for their aggressive and intimidating methods.  I landed in Etsy only to find that they were trying to implement the same practices.  I closed my shop in the end of May.

Yes everyone, Etsy is even worse with their underhanded money swiping and cutie-pie screen. They are just as bad, and will do worse because ''somebody else'' did it too.  They think that they can just learn from d-bay's mistakes to not get caught.

Thank you - but my posts are nothing compared to some of the other people who regularly post here - who do so in a better fashion then I, who make more cogent points then I, and who dont scream and rant like I do (they are way more grown up then I).

People like SIK, RIC, Annie, Sparrow, Lightening and many many others - help make this place what it is. With out their more thought out posts - it would be a mad house !

But, I owe the Steiners - I thank god they dont bill me for playing shrink (letting me let off steam) when I post about whatever the latest eBay microfraud is.

Id prefer (btw) to not to have to post at all. Id perfer to be left alone and be so busy that I have no time to come here and explain eBays latest crime.

Id also rather not have to get a lawyer to fight the button men over in San Jose.

I just want to sell my items (all legal and with paperwork to prove what and where they came from) without interference.

Get a defective? No Problem - you have 14 days to insure that "I got it right". If I didnt - exchange or refund - if you please, no problem. But just as I think I finally cleared that hurdle - the one where eBay will just leave me be to sell and not be bothered with liarbuyers, and then I get yet another stupid case. "Hi I bought an item from you, took a part out of it to use on another item, I broke it - so YOURS is defective and I want a refund now". Why? just why? Wheres the BRILLIANT AI? (Idiot women filed it under Item not received as well!)(duh you got it). It took 3 calls today to get this fixed - BUT WHY?

I appreciate your email and your thanks - but I know that if I dont work on defending myself and my fellow sellers - who will?? It surely wont be the animals who attacked the Steiners, it surely wont be that moron (wait theres 2 now) from Walmart, and it wont be "THE KING OF ALL SELLER PROTECTION IN THE UNIVERSE" aka the Sleeping Grifter.

If I were the Steiners - Id sue Wenig and take his Golden Parachute ..... but thats just me. :)

I am more likely to rant myself, and agreed, I'm sure that most all of us would rather not have to post either for the same reasons.  I never posted on forums until two years ago, and I never sold until three years ago.

I do know that it did not take long to learn how much these platforms really try to screw us, and worse, make us feel like we are the ones who are the bad guy.

I don't know if I'm lucky or it was that obvious that the community boards were just as rigged as the venues are.

And you are right, I should also extend my gratitude to the other posters you mentioned.  Without better insight and explanations and documenting more ill practices, we would not have a chance in fighting back against the corruption.

So thank you all as well.
I am not good with names, I'm sorry if I left you out.

To me, all of you have been just as helpful in sharing all of the grievances and updates as Ina and David, the very people who opened this site for all of us to learn and complain. : )

I support them if they choose not to go after the people who terrorized them,
but Mr. & Mrs. Steiner, if you do choose to give them a portion of what they deserve...TAKE THEM DOWN.

Since you just found this site I'll give you some insight

I've been here for 18+ years, eBay's demise has been predicted every single year since I came here. You are saying it again today. 5 years form now you can say it again and eBay will still be here.

Stay tuned, at this point I still have no choice but to use eBay, it's the easiest quickest way to sell used items on the internet, it was that way 20 years ago and it's still that way today.


Mark my words, it's only going to get worse once they take away our ID's. . . .
