Six Former eBay Employees Charged with Aggressive Cyberstalking Campaign Targeting Natick Couple

BOSTON – Six former employees of eBay, Inc. have been charged with leading a cyberstalking campaign targeting the editor and publisher of a newsletter that eBay executives viewed as critical of the company. The alleged harassment included sending the couple anonymous, threatening messages, disturbing deliveries – including a box of live cockroaches, a funeral wreath and a bloody pig mask – and conducting covert surveillance of the victims. 

James Baugh, 45, of San Jose, Calif., eBay’s former Senior Director of Safety & Security, was arrested today and charged by criminal complaint with conspiracy to commit cyberstalking and conspiracy to tamper with witnesses.

David Harville, 48, of New York City, eBay’s former Director of Global Resiliency, was arrested this morning in New York City on the same charges and will make an initial appearance via videoconference in U.S. District Court in the Southern District of New York.

In addition the following defendants were charged in an Information unsealed today: Stephanie Popp, 32, of San Jose, eBay’s former Senior Manager of Global Intelligence; Stephanie Stockwell, 26, of Redwood City, Calif., the former manager of eBay’s Global Intelligence Center (GIC); Veronica Zea, 26, of San Jose, a former eBay contractor who worked as an intelligence analyst in the GIC; and Brian Gilbert, 51, of San Jose, a former Senior Manager of Special Operations for eBay’s Global Security Team. They are each charged with  conspiracy to commit cyberstalking and conspiracy to tamper with witnesses and will make appearances in federal court in Boston at a later date. 

According to the charging documents, the victims of the cyberstalking campaign were a Natick couple who are the editor and publisher of an online newsletter that covers ecommerce companies, including eBay, a multinational ecommerce business that offers platforms for consumer-to-consumer and business-to-consumer transactions. Members of the executive leadership team at eBay followed the newsletter’s posts, often taking issue with its content and the anonymous comments underneath the editor’s stories. 

It is alleged that in August 2019, after the newsletter published an article about litigation involving eBay, two members of eBay’s executive leadership team sent or forwarded text messages suggesting that it was time to “take down” the newsletter’s editor.

In response, Baugh, Harville, Popp, Gilbert, Zea, Stockwell, and others allegedly executed a three-part harassment campaign. Among other things, several of the defendants ordered anonymous and disturbing deliveries to the victims’ home, including a preserved fetal pig, a bloody pig Halloween mask, a funeral wreath, a book on surviving the loss of a spouse, and pornography – the last of these addressed to the newsletter’s publisher but sent to his neighbors’ homes.

As part of the second phase of the campaign, some of the defendants allegedly sent private Twitter messages and public tweets criticizing the newsletter’s content and threatening to visit the victims in Natick. The documents allege that Baugh, Gilbert, Popp and another eBay security employee planned these messages to become increasingly disturbing, culminating with “doxing” the victims (i.e., publishing their home address). It is alleged that the very same group intended then to have Gilbert, a former Santa Clara police captain, approach the victims with an offer to help stop the harassment that the defendants were secretly causing, in an effort to promote good will towards eBay, generate more favorable coverage in the newsletter, and identify the individuals behind the anonymous comments.

The third phase of the campaign allegedly involved covertly surveilling the victims in their home and community. According to the complaint, Harville and Zea registered for a software development conference to explain their trip to Boston on Aug. 15, 2019. Baugh, Harville, and Zea (and later Popp) allegedly drove to the victims’ home in Natick several times, with Harville and Baugh intending at one point to break into the victims’ garage and install a GPS tracking device on their car. As protection in the event they were stopped by local police, Baugh and Harville allegedly carried false documents purporting to show that they were investigating the victims as “Persons of Interest” who had threatened eBay executives. The victims spotted the surveillance, however, and notified the Natick police, who began to investigate. The police learned that Zea had rented one of the cars used by the defendants and reached out to eBay for assistance.

Aware that the police were investigating, the defendants allegedly sought to interfere with the investigation by lying to the police about eBay’s involvement while pretending to offer the company’s assistance with the harassment, as well as by lying to eBay’s lawyers about their involvement. At one point, for example, Baugh, Gilbert, Popp, and Stockwell allegedly plotted to fabricate another eBay “Person of Interest” document that could be offered to the police as a lead on some of the harassing deliveries. As the police and eBay’s lawyers continued to investigate, the defendants allegedly deleted digital evidence that showed their involvement, further obstructing what had by then become a federal investigation.

The charges of conspiracy to commit cyberstalking and conspiracy to tamper with witnesses each carry a sentence of up to five years in prison, three years of supervised release, a fine of up to $250,000 and restitution. Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and other statutory factors.

U.S. Attorney Andrew E. Lelling; Joseph R. Bonavolonta, Special Agent in Charge of the Federal Bureau of Investigation, Boston Field Division; and Natick Chief of Police James G. Hicks made the announcement today. Assistant U.S. Attorneys Seth B. Kosto and David J. D’Addio of Lelling’s Securities, Financial and Cyber Fraud Unit are prosecuting the case. 

The details contained in charging documents are allegations. The defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.

eBay Inc. Issues Statement Regarding Indictments of Previously Terminated Employees

eBay Inc. (NASDAQ: EBAY) today commented on indictments separately announced by the U.S. Attorney's Office in Massachusetts against several former eBay employees. Neither the Company nor any current eBay employee was indicted. In order to preserve the integrity of the government’s investigation, eBay did not previously communicate about this matter. In light of today’s public announcement by the government, eBay is now addressing this matter publicly. 

eBay was notified by law enforcement in August 2019 of suspicious actions by its security personnel toward a blogger, who writes about the Company, and her husband. eBay immediately launched a comprehensive investigation, which was conducted with the assistance of outside legal counsel, Morgan, Lewis & Bockius LLP. As a result of the investigation, eBay terminated all involved employees, including the Company’s former Chief Communications Officer, in September 2019.

The independent special committee formed by eBay’s Board of Directors to oversee the Company’s investigation into this matter said, “eBay took these allegations very seriously from the outset. Upon learning of them, eBay moved quickly to investigate thoroughly and take appropriate action. The Company cooperated fully and extensively with law enforcement authorities throughout the process. eBay does not tolerate this kind of behavior. eBay apologizes to the affected individuals and is sorry that they were subjected to this. eBay holds its employees to high standards of conduct and ethics and will continue to take appropriate action to ensure these standards are followed.”

The Company noted that the internal investigation also examined what role, if any, the Company’s CEO at the time of the incident, Devin Wenig, may have had in this matter. The internal investigation found that, while Mr. Wenig’s communications were inappropriate, there was no evidence that he knew in advance about or authorized the actions that were later directed toward the blogger and her husband. However, as the Company previously announced, there were a number of considerations leading to his departure from the Company.

One would hope that when something so horrific comes to light, that executive's of a big multi billion corporation were committing acts so terrible, further investigation would be warranted.  

A key point was made here. It wasn't that eCommerce (Dear Ina and David) was telling untruth's but more to the fact that they were telling the truth. To me it puts the entire operation under suspicion of many more irregularities that we all know occur. The deception, outright lies, plundering and extravagances boggle the mind.

The entire business needs to be put under a microscope for any and everything. We know the numbers and financials are all BS. Who else have they gone after that didn't come forward? I find it hard to believe this was a one of. Wenig is too deranged.

A sizeable segment of the seller and poster community suffer from Stockholm Syndrome and excuse just about everything ebay does till it effects them personally, which is exactly why ebay feels emboldened to do what they do, like when staff like Trinton spew PR bullshit that everyone knows is hot garbage.

The stupid part is - that the Steiners themselves said and did nothing "wrong".

All they did is provide a space for OTHERS to say what THEY felt (right or wrong).

"Going after them" not only made no sense at all. But you can ALWAYS count on eBay to do the wrong thing. Theres never been a time that eBay is on the right side of things.

Last time - it was defending eBay against stealing money from sellers under the guise that its ok because they had to collect sales tax on a sale. No matter how hard I or anyone else tried, the few eBay @$$ kissers came out and said it was ok "cause eBay said so".

Problem was that 1) eBay under the law was already compensated for that collection so no further remuneration was needed 2) sales tax is collected from the BUYER NOT THE SELLER - so charging a FVF on it was wrong to begin with (before we got to illegal) and 3) theres black letter law that explains it all ..... but those people still argued that its ok.

Those people didnt say that here - but they arent far off from it. They defend each and everything eBay does by saying "you agreed to it in the TOS". No we didnt agree to have our rights taken away, we didnt agree to be stolen from, we DIDNT agree to be cheated lied to and swindled, and the Steiners who may or may not even be eBay sellers DIDNT agree to be harassed.

ENOUGH.

eBay has proven who they are - and its been a long 20 years for some obvious proof to show up - and Ill bet all of a certain mans drugs that theres PLENTY more - if you just dig deep enough.

What eBay employees did was wrong, more then wrong, in fact terrifying. If that had happened to me my guns would be at every door in the house. . .Besides the one i carry.

I have been stewing over this story for the past few days since it broke.

Almost everyone here has been spot on with all of the grievances from the corporate mindset, the detachment from the real workers and bread winners of this company.  
A VERY GOOD READ!!
I have also learned more from reading the posts from more experienced victims of D-bay's criminal behavior.  They have revealed a much deeper shade of BLACK in their souls. (if they had any...)  
Thank you for confirming to me how dark their corporate entity really is.

The six terrorists should be thanking Ina and Dave for going to the police.

Had they attempted such a stunt at my house, there would be seven bloody pigs heads when I was finished with them.

Their mind set is still running amok in San Jose. If they don't clean house soon, and I mean EVERY LAST ONE, then they should just BURN IT DOWN.

And I agree, ETSY, Bonanza, and the rest who think that this is a standard to treat sellers should sink too.

Just because there are some rotten apples at eBay doesn't mean the whole company is bad.

I 'm sure eBay has thousands of good people working there, people like you and me.

Just because some cops are bad doesn't mean they all are!

I make my living on eBay and have done so for 20 years and I'm not ready to bite the hand that feeds me.

I hope Marie hasn't been chased off the board or made to feel she can't post because that would be a shame. . . . .

I think people are just venting out all of the abuse from a company who have constantly displayed a double standard. (To say the least)
They also have targeted innocent people in search of someone that they had NO RIGHT to stalk.
What would they have done to said person of interest?
Like many have said here, they spent extravagant amounts of money to harass someone who was not involved with their 'problem'.
Why didn't they use that time to be productive and BUILD a better platform?
Their priorities were up their @$$ and they decided to terrorize people for disagreeing with their ideas.

For the meantime, the frustration is still focused on the crooked business practices of these platforms.
D-bay just happens to be the most noticeable for now.

About the Rioters:

I agree with all of your post but the burning down of anything in protest. In our Constitution we have the right to peaceful protest but once it gets destructive, THAT is over the line.

I just hope more Americans start connecting all the dots from the last 50 to 60 years and figure out we've all been played. There is a good ole boys network whose assets include corporations, politicians on both sides of the isle, universities, Hollywood & the entertainment industry, social medias, corporate local and national news media outlets, and so many other places of influence they use to deceive us. Just think of the issues they push out there to divide us.

I'm neither black nor white but I do believe in all Americans lives matter. To single out one race, while it has some truth to it, only serves to further divide us. A divided America only serves this good ole boy network so that we're busy fighting each other, they continue onward to their power grab of this nation. Why do you think all of their assets have been deployed to try to divide us right now? Step back and take a look at the big picture.

The good ole boy network is trying to hide their massive corruption against the American people with this division. Like I've been saying all along, this is much bigger than anyone can imagine. Americans awake to this corruption is their biggest fear and why we're having the terrible events we've been having the last few years so that you are distracted from the truth. I just hope more Americans start connecting the dots and begin to see what is really going on out there.

This is NOT a political statement as perps & politicians on both sides of the coin are assets of these terrible people behind the scenes. We know many had sold us out to China for that last few decades but it's much worse than that. This is about restoring our Constitutional Republic and the freedoms & liberties it represents for all Americans, regardless of color. We're going to find out many Americans knowingly sold us out and will have to face sedition or worse, treason. Like I said, connect the dots, it's why they are fighting so hard to keep us divided and some Americans asleep to what terrible things they have been up to in the slow methodical takedown of our Constitutional America. It's time more Americans wake up so we can take back our country!

ALL selling venues offered up to the American People MUST have government oversight and stead fast rules that will insure We have an UNINTERRUPTED income we can depend on. Much like the Post Office, it's just another service to sell our wares....No CEOs to get in the way of our success....just a nice dependable service.

Bottom line is for years and years they tried to control every aspect of ebay, and leave as least to the seller and buyer. When they got lip, they did things like this.

If you dont give your customers (ebay buyers and sellers) what THEY want, you loose. The customers dictate the market, how it works, what sells and how it sells. You cant force anything on anyone. When you do force, you loose, and that is clearly what happened. The top management is very foolish. They think they can do what they want, and it will always work. WRONG, the customer dictates, or the customer goes elsewhere. It has worked like that since the beginning of time, and always will.

Shut it down!
Funny how the extreme behaviors of those who I now detest had directed my language very much in the same manner as theirs.  

It is human nature of course, but none the less.
The actions of threats, murder, crooked business are as equally destructive.
These are the strongest matters I see lately.

Also,
I don't agree with shutting down police stations, and I don't agree with labeling all police as villains because of the bad ones. It is the same kind of profiling from the opposite side.  

I don't and wouldn't destroy someone else's property out of common respect.
More so, I wouldn't hurt anybody.
A very sovereign principle.

But if they wish to compromise my domain then I would have to 'shout' as loud as they do.

But I do feel that the people in MN have the right to express themselves in a similarly destructive manner of their counterparts if they were not heard the first few times.
To me it seems to be the only language the authorities would hear.
It wont end well, but it didn't end well last time either.

For those of you who doubt The Devil Wenig's involvement, from the criminal complaint:

On or about July 18, 2019, Executive 1’s spouse texted BAUGH privately about a comment underneath a Newsletter article that called Executive 1 a “con artist and thief.”   The spouse wrote:  “I’m not exactly thrilled with this post on my favorite [Newsletter].  The author gets people worked up with the way she skews her stories.  Don’t tell [Executive 1] I sent this I’m just letting you know about it.  Ok?”

So The Devil Wenig's wife texted one of the leaders of the terrorist cell. Why would she text someone in her husband's company's security department about a blog post? Because The Devil Wenig told her about the hit he put out on Ina.

While there may be good people at eBay, if you read the criminal complaint, it mentions Executive 1 & 2, Analysis's 1,2, & $, CW 1 & 2, so there were many more involved than were initially arrested. Why didn't any of these "good people" call the police or the FBI and let them know about the crimes their associates were committing? When Jordan Sweetnam states it was not systemic, this is the question I would ask him.

The point is and also for you ToolGuy. When the guy at the top is the lowest of the low's, the entire company is suspect, like it or not. That he was actually hired by eBay in the first place thoroughly confuses me. That he was given the top spot means that there are so many crooked little cons running through that corporation, and the BOD, it is astounding.

I had alway thought that Pierre, who started this all after all, would come forward at least one time. I guess that kind of wealth numbs you. I did reach out to him, and his wife. Found every email I could find for each of them. Just confused by allowing all he was seeing, and he surely was seeing.

Sure he hands out money to supposedly help the world, yet he stood by and did nothing. There is no way any person working at eBay is not partially responsible for this mess.
