eBay Bans All Masks Regardless of Virus Claims

eBay announced Thursday it is banning certain items associated with COVID-19, including Masks (including N95/N100 and surgical masks); Hand Sanitizer/Gel; and Disinfecting Wipes.

The company cited regulatory restrictions and wrote, "These listings may violate applicable US laws or regulations, eBay policies, and exhibit unfair pricing behavior for our buyers."

eBay had previously issued an advisory to sellers reminding them of certain policies related to such products - basically policies dealing with health claims, keyword spamming, and price gouging (see the February 28th eBay Announcement Board post).

In today's announcement, eBay said it would immediately begin blocking new listings and start to remove existing listings for the items in question. 

The move comes amid reports of shortages and price gouging on such items, as described in this CNBC article.

Note that as the CNBC article makes clear, this is not just an eBay issue, and Amazon has come under fire for inflated prices, as The Verge reported. (Repricers gone wild?)

And still almost a week later there's thousands of these "banned" items son eBay, including newly listed, and still being sold. They take a few token items down here and there but everything else is left alone. What a sham. It's always a guarantee eBay will never do what they say. This was nothing more than a PR move.

NY State and CA both price gouge in what they charge in taxes yeti no one complains.

The Federal government makes 3x as much as Texaco does on a gallon of gas - is that not price gouging??

eBay did not need to remove (certainly) all listings- it was over reach and over reaction

eBay was wrong again.

And in case of listings that were price gouging- couldn’t CA deal the seller directly- why was eBay involved??

This isn't / wasn't a discussion on Taxes.  Completely different subject and I would agree that there are taxes that are simply outrageous.  My property taxes is a great example.  But again, not the issue under discussion.

Ripping people off/stealing is just that, nothing more

The government does it/eBay does it and you give them a pass. Yet when a seller does nothing wrong - they just sell their wares - you claim it’s ok for either or both to clamp down and take away their rights “just because” ... where is that ok?

There was/is no proof of eBay sellers ripping people off, yet there’s plenty of proof of eBay ripping off sellers - my how things change when the shoe is on the other foot isn’t it??

The government issued a warming to “mr eBay”, eBay woke up from its slumber and threatened its sellers and then went too far as always.

You “can’t have it both ways” either it’s theft when you rip people off or it isn’t.

I wonder at what point people are going to stop purchasing items from private sellers on sites such as eBay because the buyers will be afraid the seller has COVID-19, will infect their Furby (or whatever the buyer is purchasing), and assume that item will pass the virus on to them. This is the second day in a row I haven't had any sales, which has not happened to me in many years.

I was one of the sellers on eBay selling masks from China. Before someone judges me, I lost my job due to the outbreak, and was three months without any income since January. I sent worth $2000 of masks to friends in the US for free although I already had difficulty without any income and when their friends wanted to get some as well I opened a eBay store. I shipped by DHL, provided shipping, and the items arrived in 4 days. My package bundle included a $5 and $8 dollar margin for myself, I had to go to the DHL store every day and queue up there for three hours to ship out the package (that is how much is shipped right now in China).

According to Paypal and eBay the money would be held in my account for 21 days. But since I saw the money was there, the buyers had purchased the item, I didn't see a big risk. I borrowed money from friends and family to keep up with people putting in new orders thinking I was doing what I could as an individual who is unemployed now to make the masks available. I don't own a mask factory, I don't sit on masks, I purchased them one by one as orders came in. I never bought a KN95 mask for myself during this whole outbreak time, only wore the blue ones FYI.

Then one day eBay took down my listings, later on restricted my account. All the items I sold on the platform were exactly as described in my listing, didn't make any false claims, and arrived earlier than expected (I said it would take 3 days processing time before giving a tracking number, and it would take 7 days to receive the package). All my items got to the buyer within less than a week (I have UPS/ DHL tracking that is on the eBay website and all was delivered).

When eBay took down my listings the majority of buyers put in a request for a refund (on average they had put in their order 1-5 days) with the reason being 'item not received'. My orders get processed immediately when an order is made, the three days processing is for the item to be shipped from the factory to DHL and my listing states that there are no returns. According to eBay's policy, when a request in the resolution center is made, seller and buyer have 3 days to sort out the issue before it can get escalated to eBay for a final decision. But that was not the case. When the buyers put in a request, eBay approved it within minutes without giving me any chance to address it. As I already said this claim with reason 'item not received' is not even valid, because I never claimed the buyer would receive the item immediately. Since eBay removed my listings I cannot appeal the decision, I cannot open a new request, I cannot report the buyer for receiving an item and not having paid me. I gave away all of this for free and now I have to find a way to pay back my friends and family.

I don't know what to do, this is so terrible. I lost so much money and thought that I was protected through eBay and PayPal seller protection. I can proof that I did everything right, that I sold masks at a fair price ($5-$8 margin) and all of these masks made it in time to the buyer. When I contacted PayPal they closed the case immediately saying that is on eBay's side, they can't help. Since their phone hotline is not available I contacted them by chat and they closed my chat request after I waited for them for 2 hours.

Since eBay took down my listings and restricted my account they kept sending me emails saying 'send us proof that all items have been received and we will open your account again'. When all items had been received (without exception) in the buyer's hands I contacted them again and they said 'all looks good, now just pay our service fee and we will reassess your account since your account looks good'. But when I asked them about where my money is that I should have received they never replied again. I filed several requests through their system and nobody ever replied to me.

Please, does anyone have any advice what can be done? I can show that all I have stated above is true, everyone has received their package, and I even received messages on eBay from satisfied buyers who said they couldn't understand why my listing was taken down and that they are so thankful for the package they received and are sorry that they don't seem to be able to write me a positive review (because my account is restricted). Any advice anyone could give would be very much appreciated, I am still unemployed, I did this because I thought it would make masks more available, and I have never done anything bad, no buyer complaints about my products. Hope somebody can help, thanks.
