Law Enforcement Has Eyes on Amazon Sellers

Amazon will ramp up counterfeit reporting to law enforcement, according to an article published by Reuters on Monday. 

That makes it even more imperative that sellers understand Intellectual Property laws and be careful when procuring inventory rather than rely on wishful thinking.

The Amazon seller boards are full of reports like the following: "I have recently been issued an IP infringement on a product I basically purchased off the shelf from China."

As experienced Amazon seller Oneida_Books explains in a guide published on the Amazon boards, "Many sellers think their source is OK when it is not ... They MUST be recognized as having the right to give you the right to resell."

Oneida Books updated the guide on February to specifically address authenticity complaints, advising colleagues that retail receipts are generally not acceptable, nor is Alibaba/AliExpress - see the thread for details and advice.

It's far better to do your homework before procuring and listing inventory online than to jeopardize your selling accounts or face scrutiny from brand lawyers or law enforcement.

According to Reuters, which cited a person familiar with the new Amazon program around fakes, "In recent weeks, Amazon has held meetings with government authorities and related organizations to discuss its new counterfeit reporting strategy and how the company can further their enforcement efforts."

how about start with the source? yes Americans are stupid BUT if the corrupt federal government would simply put a halt to fake chinese product - and they know - that would cut down on fraud.  It's gone on for so long now - politicians in the pockets of the chinese how's it going away? yes we started it - corporate america looking for cheap product and labor - we are all bearing the weight of greed.

Amazon has been allowing counterfeit TransFormers  since at least 2013, with "KO"  and "knockoff" in the title even.  eBay usually hides them under "China version" keywords.  When those listings were reported, all either of them said was "not enough proof" or "complaint must be filed by Takara."  That BS was half the reason I stopped carrying TransFormers outside of the occasional retail flip.

Well if this is true, then AMZ should allow sellers (like me) to post a picture of the price tag.  I list new clothing on AMZ and everytime I have listed a picture of clothing w/ the tags (showing the original price) AMZ flags it and I have to hide the tags.

100 years ago, it was the cheap American counterfeits flooding the world that caused so much anger and angst. Now it's Chinese goods that are to blame for everything. And still no one can manage to propose and create a world trade system to identify, prosecute, convict and punish pirates of intellectual property, trademarks and copyrights. Until there is a World Trade Court system for managing fakes, the problem will NEVER go away.

First doctrine does apply.  Amazon and eBay make claims about what is or isn't "legal" all the time, but you need to remember, they aren't an authority on that, nor do they have the authority.

For example, the whole "no class actions" clause.  Totally unenforceable, any judge would laugh at the idea that Amazon or eBay can restrict HIS authority to create a class.  Yet, people act like it's an immutable commandment from God.  It's not.  Do you have a recent example of a class being denied on the basis of that clause?  No.

Sure glad that law enforcement is watching me. I'm glad that they don't have anything better to do. Maybe some of them should be laid off or fired. Watch away guys.
