Rep Tells Seller eBay Lacks Resources to Fight Fakes

Dear Ina,
In the process of getting my eBay listings prepped for my upcoming holiday sales I decided to take a look at my competition on eBay. Not so surprisingly, I found a whole bunch of people in my category trying to pass off fake name brand jewelry as authentic and others putting in a brand name in their listings to get their items to the top of the search for that particular brand(s).  

I proceeded to call eBay (twice) to alert them of the flagrant misuse of sellers (many from China) gaming the system with fake items and deceptive listings. I also told the rep specifically how some sellers were hiding the brand name in the variations area so their products could be seen in the eBay search engine when buyers search for the name brand item. 

I was told how great I was for calling to alert the eBay team of these issues, that no one else has ever called them to say this was happening, and that these buyers would be hit with violations immediately.  

That was 2 weeks ago. Of course the same sellers are still on eBay selling the same items in the same category using the same brand name on their fake items and having the same deceptive listings.  

I called again today to report the same items and additional ones and was told that eBay probably didn't have the appropriate number of team workers to actually follow up on the violations so the most they were probably doing was giving the sellers notice of violations (IF that was indeed happening) and then not following back up to make sure the corrections were being made.  

I can't compete on eBay with this going on and I cannot believe that eBay allows it to happen. It seems to have gotten worse every year because nothing is done about it. They wonder why they have lost so many buyers?! And eBay is trying to lure new buyers in with tv ads, but what good does any of it do if a new buyer tries to buy an eBay item and discovers that it's fake?  Of course the new buyer will not only never buy on eBay again, but spread the good word to their friends.  

I'm very perplexed about how this is allowed to happen!!! So what should I do - give up on eBay or start selling fake items like everyone else is doing???

Ebafia doesn't allocate enough resources because they actively encourage fakes. They make money from aiding and abetting all kinds of fraud, and knockoffs are no exception.

A few years ago Devin Wenig was quoted in some magazine stated ebafia kept track of vintage item searches and the let Chinese knockoff sellers know they should copy it and list the fakes on ebafia.

I'll see if I can dig up the article and post the relevant excerpts.

Wish I had been keeping up with Ebay shenanigans quite some time ago. The vintage search list to Chinese by Wenig is absolutely disgusting. Maybe that should have been sent out as a seller announcement. How we are helping you as a seller by killing your market off with cheap replica's.

Yes, this is just one of the business killing things our self-proclaimed "partner" does.

It was Ina who brought this article to our attention in 2014.

When Trump was campaigning he railed against this type of Chinese business practice among others he SAID he didn't like. Today and toady John Kelly can't say enough nice things about them.

Ebay is a swamp in serious need of draining!

Ming, I agree. It really doesn't get much lower than passing info off to the Chinese as""want lists" to compete with the sellers you are charging fees for listing and stores to sell the genuine items.Vintage espionage in a sense. For what. To make 25 cents 10 times instead of 5 dollars on the genuine item. It then devalues the genuine item as it has a 10 fakes for every real one. Way to promote customer confidence Ebay. Not only is ebafia one of the world's three largest Chinese made junk dollar stores (others are Amafia and Walmart) it's also quite likely the world's largest purveyor of stolen merchandise and pornography.

Even with a police report, ebafia does nothing with stolen merchandise reports.

Regarding the above: I meant purveyor in the sense that they purvey by providing a platform for a thief to sell stolen merchandise on their platform including even though they've been apprised that the merchandise is stolen.  

Ebafia itself sells nothing which they seem to forget 100% of the time. Despicable doesn't even begin to cover it.

Ebay could easily supply the resources to take care of these issues if they wanted to, but if they got rid of all the counterfeit stuff from China and cracked down on stolen goods they would suffer to large of a drop in revenue to survive.  They also encourage the scammers because then they make double the money as the scammer usually resells the item on Ebay resulting in double the revenue for Ebay.  They have already shown what happens when they do not make the revenues they had hoped to by reinstating the 3rd party ads that take the buyers off of Ebay just so they can get some click through revenue.  The Promoted Listings program has been such a failure they had to find a way to make the revenue back, so they violated their promise to sellers to remove the ads completely.  Of course this is all Ebays fault since they cannot provide a Promoted Listings program that works properly and does what it is intended to do.

By the way, as an addition to what Ming said about Wenig and Ebay supplying the information to China about the hot items, they also gave them the specs necessary to make them, which is why Ebay recently changed their UA to state they can use any and all data including Intellectual Property that is uploaded on their site in any way they see fit.  Ebay seems to feel they are above any and all laws because of their arrogance.  I would love to see how they explain they are just a venue in the next class action lawsuit they wind up with.

eBay knows EXACTLY whats going on, but houses in the Caymans, BILLIONS of dollars sitting in offshore accounts, LARGE salaries and PERKS to board members simply gets in the way of any crackdown on fakes on the platform. Its just that simple.

People get offended when I and others here say that eBay is basically the Sopranos - just not in Jersey - in San Jose.

Theres NOT ONE THING that eBay does thats not quasi illegal or illegal OUTRIGHT - but no one cares because they too benefit from the FLOOD of money that eBay makes off these items.

eBay "knows its lucky" that it doesnt get any scrutiny from regulators, state of government officials - because they are all focused on the "real bad boy Amazon".

Amazon being 50-100x eBay (in ecommerce and scope) gets all the attention. When Jeff Bezos farts - its get more attention then ANYTHING eBay can do - and eBay uses that knowledge as away to escape issues. That is unless a big manufacturer takes eBay to court - which is as rare as finding a multicolor unicorn who lays gold eggs.

Im in the electronics end of eBay. Ive been in the electronics business since 1984 - and have a "reputation" in the business - ie "I didnt just get off the truck yesterday".  The point - Ive told eBay MANY times about fakes - and they laugh at it OPENLY.

Ive sent them pictures (comparisons between real and fake), links to the makers websites,  and more - all to no avail. Thats why I compare reporting fakes and bad buyers to emptying the Atlantic Ocean with a dixie cup - usesless.

eBays "deal" with the courts (the creation of VERO to stop fakes after its loss in the Vitton case) and the %100 bs VERO "does" - DOESNT even deal with fakes - unless some $12 an hour person at some large company trolls eBay and faxes them in a "report".

VERO is PURELY pay for play - like the Sopranos - companies pay for the software to FIND FAKES, buy Platinum Stores in return for "a crackdown" and other games - its just like "on tv".

Theft is rampant - by eBay against its sellers, by "eBays buyers" against its sellers, and by its other 1/2 Paypal against its sellers.

THERES NO PART of eBay that ISNT fraud.

You pay to list an item and agree to the OUTRAGEOUS %10 VIG on "shipping" and STILL you cant be guaranteed that your listing will be shown 24/7/365. It "may" get shown, it "may" get show only in certain places, it "may" get shown with outside competitors right underneath yours, and then even if it is shown - eBay helps "buyers" find ways to NOT choose you. Dont offer free shipping, free returns, 60 day returns and send DW a bday card for his cat - then eBay creates menus on the side to help HIDE your listings yet again!

Of course the ENTIRE returns section of eBay is fraud - from the complicity of the CS agents overseas, to the fake returns area in eBay help section. Better yet the eBay "blues" ala TRINTON - openly say they dont care what the help section says and that they have the power and DO make up new rules against sellers AT WILL with the OK from San Jose.

Id rather deal with the REAL mob then fake ones in San Jose ... but they dont run an online ecommerce business ... yet.

Yes, quite right [referring to the August 6, 2014 "Atlantic Monthly" article about eBay forwarding sales data to Chinese manufacturers]. It would be a blessing to have access to meaningful data from eBay about what is selling, to whom, at what price, on what terms, etc. I can say that receiving a message from eBay that my price should be lowered based on comparable sales is suspect when it shows my own item as the basis for the comparison and I am top of the heap in "Best Match" with 2 sales in the past hour.

fleecebay is to busy watching for a seller to cancel a listing, then charge FVF on the item because they think the item was sold off fleecebay.

also to busy monitoring m2m messages for possibly using a listing number that fleecebay thinks is a phone number

fakes? no, fleecebay has to let those stay up. the ceo I am sure is getting a kickback from the china garbage that he personaly gave the fraudsters the information
of what fakes to make.

No surprises here. Ebay doesn't have the resources to manage any facet of their business appropriately. The resources they do have are wasted worrying about off site sales, taking punitive actions against sellers, manipulating visibility and creative accounting tricks.

LOL, partnering with the criminal counterfeiters is ebays bread and butter. And what is absolutely the ultimate travesty of this massive counterfeiting problem is that the trademark rights owners are in most cases no longer taking any actions on ebay.

Take a look at sports league items (NFL, NHL, NCAA, MLB, etc), Disney, Star Wars, just about any trademarked character like Batman, Superman, Spiderman, etc, rock/country/TV stars. Browning, John Deere, Harley Davidson, Auto manufacturers, etc etc etc etc - and there are literally 100,000 of thousands of fake counterfeit items. There are Chinese and USA sellers alike that have been selling this fake crap for 4-5 years now unabated!

So some questions about this! Is it being condone by the right holders? Are the right holders in cahoots with the marketplaces (aka: Is ebay paying them a pseudo license fee on sales?)? Are the right holders just no longer willing to play the game of whack a mole (as Chinese sellers taken down are back up the next day under another id)? What is it? There has to be an underlying reason why Disney allows ebay to allow counterfeiters to selling 10s of millions of dollars of fake Disney items on ebay?! Same with the NFL! I have reported 100s of counterfeit sellers to the their brand protection group, and they do NOTHING ABOUT IT! WHY?!!!! It makes NO SENSE! There is a virtual cesspool of counterfeit items out there and they are dominating most sub-categories of items and even coming up with new items and disgusting items (like Fxxx you shirts, etc) that the companies would NEVER allow... Its just a complete and total disaster!

What do you think it is, as the right holders are not protecting their trademarks, and are now TOLERATING it, which makes it even worse. Years ago, people would be afraid of legal ramification to counterfeit items like this of powerhouse companies, but what you see today is the criminals are openly selling items, expanding and what the worse is the normal everyday person that would never counterfeit sees these people getting away with it, so they are all jumping into the game. So its growing exponentially..

Take a look at vinyl decals, printed items like pictures, tshirts ) and patches/embroidery (to put on caps and clothing items). There are 1000s of people selling trademark infringing items they make, some making $100s of thousands a year that are stealing from these companies. And nothing is done!

I don't think this problem will ever be resolved unless the feds step in, or this goes on a big screen like 60 minutes and/or a nightly news feature... Ebay is going to continue to allow this as they profit from it and will continue until they are exposed or prosecuted!

Sure hope something is done as this is the biggest and most crippling problem on ebay today. And its expanded into just about every product out there. Look at items like phone chargers. I wanted to buy one, and the exact same listing desc, picture, location, terms etc were in over 200 different listings at the top of best match and lowest price. They were from 200 different seller ids, but it IS ALL THE SAME CHINESE PERSON SELLING THEM. They all said USA with a New Jersey city, but shipping time was a month, so you know they were coming over from China in an epacket. And the damn thing will probably burn your house down!

Oh well, I will get off my soapbox. Just so frustrated that ebay allow this criminal activity and that the right holders seemingly have stopped enforcement and now are basically tolerating and in effect condoning it. Ina, this would be good research feature to call some of these organizations and ask why they are not doing anything about counterfeiting on ebay

And PS: I recently reported a criminal seller to the brand protection group for one large company. They immediately took down over 500 listings, and 3 smaller companies also took down many more. So this criminal had 4 vero claims, but he is still selling counterfeit stuff and sell more than you and I combined. You would think that ebay would remove him from selling or at least penalize him, but he is still actively selling counterfeit items and his volume is still tremendous.. And before I reported them, I used a 3rd party site to calculate his gross sales, and it was $701,000 so far this year. And all counterfeit unlicensed items... Put that in your crockpot and stew over it for awhile! We all need to report the criminals in our niches to the brand protection groups of the owning companies. Maybe if we put the fire under ebays butt they will learn that they need to be honest and do what is right and ethical!

I have learned from experience Ebay is ANYTHING but ethical. I would love to see what Disney had to say. I saw Harry Potter stuff that looked like knock-offs too. I don't get it either. The American public needs understand how FAR reaching this whole fiasco actually is.I think it would make a great 60 minutes , they could go over the e-packet deal and how we help our postal system lose 280 million a year buying this junk.

And just out of curiosity, any taxes get paid US on any of that. We need a tariff on Chinese goods for so many reasons just starting with the 200 plus billion dollar deficit.

Studiolines, Yes, I think you are right that no U.S. taxes are being paid by these Chinese sellers. Its just a loud sucking noise as money leaves our great country by trademark theft, undercutting us sellers, subsidized postage and loss of tax revenue..

How ironic!!!! Don't ya just love it. All of the above posters crying about how ebay and or amazon and or etc allow all the chinese fakes on their site.

Yet these same posters are selling on ebay. Talk about biting the hand that feeds you.

If you so upset and outraged maybe ya all should sell elsewhere.

The solution to this is to buy the item and then claim it's a fake.

You get the item for free and the seller of the fake merchandise loses!

If enough people do this the seller will be out of business. . .
