eBay Account Rep Defends Reality TV Star Accused of Shill Bidding

By: Ina Steiner

Friday's EcommerceBytes newsletter includes a news story about high-profile eBay drop-off store owner Corri McFadden who was accused of shill bidding on eBay by a poster on the PurseBlog.com discussion boards.

McFadden's company, eDrop-Off Chicago LLC sued both the poster and PurseBlog.com. Twice, first on Thursday and then on Friday.

It filed the first lawsuit in California where the courts have a generous anti-SLAPP law, the second the next day in Illinois where its anti-SLAPP law is viewed more narrowly.

McFadden is an interesting person - she has been profiled by eBay on several occasions and now appears on her own TV reality show about her eBay consignment business.

If the defendants make it to trial and have the resources to defend themselves fully, I imagine they will try to show that the seller was indeed shill bidding - it will be interesting to see what records eBay will surrender about the bidding activity on eDrop-Off's auctions.

One of the most interested aspects of the case is a letter McFadden's account manager wrote testifying that eBay had investigated her account and found that she does not engage in shill bidding - "we at eBay have thoroughly investigated the eDropoff account and currently have no reason to believe that a Shill Bidding violation has taken place."

It's unusual for eBay to vouch for a seller's reputation!

eDrop-off also wrote in its Illinois lawsuit that it believed the defendant, "BeenBurned," previously operated under the handle of "bargainprincess" and has "self-styled herself as a scambuster and detective of auctions on eBay. Plaintiffs are informed and believe that due to her unauthorized attacks on, and cyberbullying of, legitimate Internet companies, BeenBurned has been banned from eBay and her account was involuntarily deactivated some time ago." (I'm curious who informed McFadden of BeenBurned's alleged history and alleged ban from eBay.)

Can you tell without a doubt if a seller is engaged in shill bidding? Or is accusing someone of shill bidding on public discussion boards "cyberbullying"? Let us know what you think!

Because ebay is known for looking the other way or looking into things half assed. Anyone who has ever called and spoken to an ebay rep will know what I'm talking about.I'm hoping they are forced to provide IP addresses to their numerous shill accounts.

@kbk, are you ''beenburned''?

Now seriously, I was searching in Google for the that beenburned. She has a club of haters.

If beenburned has the re$ource$ and time to go forward with the sue. She will have to make eBay gives all info from nicknames, address, and IPs of the buyers (bidders and winners). Then search/contact info about this people.

In my opinion not matter who wins in the court, everybody will loose. If McFadden win, the case will help any future censorship legislation/bill propose from companies and organizations (like the SOPA). Then in some years forums/blogs will be old history. If beenburned win, somebody will loose buyer respect and eBay will looks like lazy guard dogs with a non-trust group of sellers. eBay will need to improve this problem and they will just a new excuse to add more fees to ''solve'' the problem.

In both cases sellers will continue to look like the bad guys.

I don't think Been Burned is posting anywhere right now.

Everything posted above and on the original thread that edropoff FORCED to be removed was readily available by looking at the bidders on her auctions and their bidding histories.

Why did ebay let Chris Von Waggoner, edropoff's account manager, write a document that was submitted in Federal Court saying that Ebay checks ALL sellers for shill bidding when this is not true?   Can Ebay get in trouble with the court when an employee lies like this?   Everyone knows eBay doesn't, as a standard function, check EVERY seller for shill bidding.  BS on that!

Additionally edropoff's owner, in her OWN POSTS said that Ebay told her it was ok to have her employees bid on her auctions as long as they didnt use her computer and did it from home???  And Ebay said that was ok?   Really?

Ina what does Ebay have to say about this?  You really should follow up on this.

If you check edropoffs' list of employees you will SEE that her employees are not only bidding on auctions, they are winning them and leaving their boss GLOWING FEEDBACK.

Isn't that also feedback padding?  That's not allowed on Ebay either, is it?

So why hasn't Ebay closed the edropoff account yet?   She appears to be breaking Ebay rules right and left - and trying to convince everyone that Ebay said it WAS OK TO BREAK THEIR RULES?

Wonder how Ebay attorneys feel about this?  Is this the new defense?  ''I had my employees bid up my auctions because Chris Von Waggoner and Ebay staff said it was OK!!!''

Yeah, right.

I nominate edropoff and their owner, Corri McFadden for Power Seller of The Month.

Anyone remember that fiasco?  lol

LOL, no I am not BeenBurned. Just another person 'mad as hell and not going to take it anymore'.

There are a few IDs that you can play the name game and match to an employee name in a 'kinda maybe sorta if I turn it this way'. It appears to me that one employee, JENA GAMBACCINI, has consistently bid (and is still bidding!) on this seller's auctions.

http://feedback.ebay.com/ws/eBayISAPI.dll?ViewFeedback2&userid
=jenagambaccini&ftab=AllFeedback
The
connection:
now check out this page and THE NAME ON THE FLYER http://corrimcfadden.com/
Now check out her 'social media coordinator' http://www.shopedropoff.com/content/welcome-edrop

An employee connection has been submitted to ebay, irrefutable proof provided and admission by the seller that acknowledges employee interaction is sanctioned.  ALL offenses that Ebay says they wont tolerate, which violate not only Ebay policy but California law for shill bidding and that eBay says that they refer to law enforcement and close the accounts of those caught shilling.
So when will we get Ebay's confirmation that they deal with this shill bidding and they will be taking the appropriate measures against this seller?

I wonder how Ebay feels about Chris Von Waggoner, one of their top account managers,  putting before the federal court IN WRITING that Ebay screens ALL big sellers on the site for shill bidding and infractions and stating that edropoff doesn't shill!     So does Ebay say ''oops Chris was wrong and lied or do they say that their policy changed and it's NOT shill bidding if employees are bidding up a seller's items?   I wonder, can Chris Van Waggoner get in trouble since, IMO, it's very clear what he wrote is NOT TRUTHFUL at all.    And since he knows how to detect shill bidding shouldn't he have been taking action against this seller instead of trying to baffle and BS everyone into believing that Ebay actually looks for shill bidding??

ebay needs to step up on this one. Since the seller has literally made a Federal case out of this, policies need to be enforced

I couldn't agree with you all more. All I know is that I will not rest until Corri McFadden, Chris Von Waggoner, Jenna Gamaccini and all others have been forced to tell the truth. VH1 and 44 Blue is never going to hear the end of this.

Has anyone ever considered that eBay could be running bid bots within their intranet?

It would be easy to do without being detected from the outside world. eBay knows the reserve on an item so they would know how far to push up the bids.

I have often thought of this when some newbie came to the EBMF complaining about 0 feedback bidders winning their FREE car auction at $125 FVF. The deadbeats seem to target a newbie private seller over an experienced dealer. At least on eBay Motors anyway.

As for that PurseBlog link that Ina published, It's still active. But even a newly registered account can't access it. But i managed to grab a few screen captures from Google's cashed page search.

Some as recent as today: http://www.narumessenger.com/forum/ebay/reality-tv-star-accused-of-shi

If it were ebay bots, they wouldn't need all the bid retractions/ relists. Since they know the reserve and all.

Justiceforall, That may be true.

But with everything else that eBay is alleged to have done. Trying to silence reporters by filing phishing reports with their hosts, alleged DdoS attacks (I really think eBay was behind the DdoS on my other site). Anything is possible. A bot can be programmed to retract bids too, among other things.

But an insider squealing what is going on would probably wind up like one of Al Capons guys that got caught skimming!

@ kbk Re: complaints board site; The point is the situation is so scummy and psychotic it will make your stomach turn and toenails curl. Who knows who is who, but the ambiance is that of something extra special slezy, beyond imagination. That's ebay's aura. (as is this situation)

But how can any reasonable person, let alone experts, such as ebay purports to employee regarding shill bidding, look at that feedback left by Member jenagambaccini along with those bid histories etc, and not detect shill bidding?

Is anyone THAT stupid or blind? Or is more like willful blindness?

I suggest writing to any Hollywood gossip columnists you can think of, since there is a TV show involved. Send screenshot links and quotes. (unless some goombahs are going to try and have them all shut down?)

Facts are facts.

What next? Do people need to worry that someone will show up to break their kneecaps for pointing out obvious fraud?

The ''CDA'' mentioned in passing is the ''Communication Decency Act of 1996.''  While parts were struck down as unconstitutional, the part applicable to Ina Steiner's article survived:

47 USC ยง 230 - PROTECTION FOR PRIVATE BLOCKING AND SCREENING OF OFFENSIVE MATERIAL
http://www.law.cornell.edu/uscode/text/47/230

We recommend that folks writing online articles and comments, read the law and view the following:

Section
230 Protections

https://www.eff.org/issues/bloggers/legal/liability

Online
Defamation Law

IN OUR OPINION, PurseBlog.com's liability in regards to comments made on it's site:

''No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.''

The plain English version:

''readers' comments, entries written by guest bloggers, tips sent by email, and information provided to you through an RSS feed would all likely be considered information provided by another content provider. This would mean that you would not be held liable for defamatory statements contained in it. However, if you selected the third-party information yourself, no court has ruled whether this information would be considered ''provided'' to you. One court has limited Section 230 immunity to situations in which the originator ''furnished it to the provider or user under circumstances in which a reasonable person...would conclude that the information was provided for publication on the Internet....''''

The liability of the posters, or lack there of, is another matter.

''Is Section 230 limited to defamation?

No. It has been used to protect intermediaries against claims of negligent misrepresentation, interference with business expectancy, breach of contract, intentional nuisance, violations of federal civil rights, and emotional distress.''

So Ina, are you going to follow up with Ebay and ask if they really DO condone shill bidding and feedback padding?

Will Chris Von Waggoner at Ebay provide the same written document for ALL sellers and clear them when they are accused of wrong doing?     I would hope Ebay would be fair and make the same available to ALL sellers.   I mean, now that they've provided it for one seller (who IMO didn't deserve it).

And Ina are you going to follow up with VH1 and ask how they feel about this?  Pretty damning to be associated with this, I would think.

And oh boy!  Uggg.  I wish someone hadn't suggested that we watch edropoff's show.  Is this really something people consider entertainment?   Gawd!

But what is up with this seller and her employees gleefully BOASTING and BRAGGING on the show that when they get items on consignment they get to WEAR THE ITEMS while they are listed on ebay for sale?

Do the people sending in items to be sold know that Corrie lets her staff use the items first?   What happens if an item is stained, torned or damaged?  Does Corri pay for that?  Is it disclosed to the buyer?

Do all consignment stores let their employees wear the items that are sent in for sale that are owned by someone else?  Is this standard practice?

Threads may deleted, but if ebay makes them disappear from the system then they are destroying potential evidence.

Defendant could do a pro se motion to the same courts asking the courts to order ebay to preserve all the defendant's activity including the IP numbers from any of her suspected service providers.

I believe that ebay is required by law to preserve everything anyway, but it would be very prudent to make sure.

Of the ways around defamation is satire. Check it out ;-)

@ trickstunt:
Yes, I agree with you. When common sense should have prevailed, it did not.

''''But how can any reasonable person, let alone experts, such as ebay purports to employee regarding shill bidding, look at that feedback left by Member jenagambaccini along with those bid histories etc, and not detect shill bidding?''''

Well, I guess Chris Von Waggoner is that special person.

You have to ask?? :-)

EXACTLY!!!!

@Doc, about the bot idea. After see some videos of crazeenydriver and my personal experience with non-payers with zero feedback. I will not surprise that eBay has any bot system looking for sellers not following rules to ban them from the site or limit their sales. Also I will not surprise that eBay use some similar idea like a "mystery shopper".

@createursdeluxe, So I'm assuming that program operates like the program at the Purse Forum. If you comment on that site then your IP address is assigned to that comment. Just as eBay has the IP address attached to each bid, the PF has an IP address attached to each comment.
